92_SB0174eng SB174 Engrossed LRB9202677LDpr 1 AN ACT in relation to gambling. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 15. The Bingo License and Tax Act is amended by 5 changing Section 2 as follows: 6 (230 ILCS 25/2) (from Ch. 120, par. 1102) 7 Sec. 2. The conducting of bingo is subject to the 8 following restrictions: 9 (1) The entire net proceeds from bingo play must be 10 exclusively devoted to the lawful purposes of the 11 organization permitted to conduct that game. 12 (2) (Blank).No person except a bona fide member of the13sponsoring organization or a bona fide member of an auxiliary14organization, substantially all of whose members are spouses15of members of the sponsoring organization may participate in16the management or operation of the game.17 (3) No person may receive any remuneration or profit for 18 participating in the management or operation of the game, 19 except that if an organization licensed under this Act is 20 associated with a school or other educational institution, 21 that school or institution may reduce tuition or fees for a 22 designated pupil based on participation in the management or 23 operation of the game by any member of the organization. The 24 extent to which tuition and fees are reduced shall relate 25 proportionately to the amount of time volunteered by the 26 member, as determined by the school or other educational 27 institution. 28 (4) The aggregate retail value of all prizes or 29 merchandise awarded in any single day of bingo may not exceed 30 $2,250, except that in adjoining counties having 200,000 to 31 275,000 inhabitants each, and in counties which are adjacent SB174 Engrossed -2- LRB9202677LDpr 1 to either of such adjoining counties and are adjacent to a 2 total of not more than 2 counties in this State, and in any 3 municipality having 2,500 or more inhabitants and within one 4 mile of such adjoining and adjacent counties having less than 5 25,000 inhabitants, 2 additional bingo games may be conducted 6 after the $2,250 limit has been reached. The prize awarded 7 for any one game, including any game conducted after reaching 8 the $2,250 limit as authorized in this paragraph (4), may not 9 exceed $500 cash or its equivalent. 10 (5) The number of games may not exceed 25 in any one day 11 including regular and special games, except that this 12 restriction on the number of games shall not apply to bingo 13 conducted at the Illinois State Fair or any county fair held 14 in Illinois. 15 (6) The price paid for a single card under the license 16 may not exceed $1 and such card is valid for all regular 17 games on that day of bingo. A maximum of 5 special games may 18 be held on each bingo day, except that this restriction on 19 the number of special games shall not apply to bingo 20 conducted at the Illinois State Fair or any county fair held 21 in Illinois. The price for a single special game card may not 22 exceed 50 cents. 23 (7) The number of bingo days conducted by a licensee 24 under this Act is limited to one per week, except as follows: 25 (i) Bingo may be conducted in accordance with the 26 terms of a special operator's permit or limited license 27 issued under subdivision (3) of Section 1. 28 (ii) Bingo may be conducted at the Illinois State 29 Fair or any county fair held in Illinois under 30 subdivision (3) of Section 1. 31 (iii) A licensee which cancels a day of bingo 32 because of inclement weather or because the day is a 33 holiday or the eve of a holiday may, after giving notice 34 to the Department, conduct bingo on an additional date SB174 Engrossed -3- LRB9202677LDpr 1 which falls on a day of the week other than the day 2 authorized under the license. As used in this 3 subdivision (iii), "holiday" means any of the holidays 4 listed in Section 17 of the Promissory Note and Bank 5 Holiday Act. 6 (8) A licensee may rent a premises on which to conduct 7 bingo only from an organization which is licensed as a 8 provider of premises or exempt from license requirements 9 under this Act. If the organization providing the premises is 10 a metropolitan exposition, auditorium, and office building 11 authority created by State law, a licensee may enter into a 12 rental agreement with the organization authorizing the 13 licensee and the organization to share the gross proceeds of 14 bingo games; however, the organization shall not receive more 15 than 50% of the gross proceeds. 16 (9) No person under the age of 18 years may play or 17 participate in the conducting of bingo. Any person under the 18 age of 18 years may be within the area where bingo is being 19 played only when accompanied by his parent or guardian. 20 (10) The promoter of bingo games must have a proprietary 21 interest in the game promoted. 22 (11) Raffles or other forms of gambling prohibited by 23 law shall not be conducted on the premises where bingo is 24 being conducted, except that pull tabs and jar games 25 conducted under the Illinois Pull Tabs and Jar Games Act may 26 be conducted on the premises where bingo is being conducted. 27 Prizes awarded in pull tabs and jar games shall not be 28 included in the bingo prize limitation. 29 (12) An organization holding a special operator's permit 30 or a limited license may, as one of the occasions allowed by 31 such permit or license, conduct bingo for a maximum of 2 32 consecutive days, during each day of which the number of 33 games may exceed 25, and regular game cards need not be valid 34 for all regular games. If only noncash prizes are awarded SB174 Engrossed -4- LRB9202677LDpr 1 during such occasions, the prize limits stated in paragraph 2 (4) of this Section shall not apply, provided that the retail 3 value of noncash prizes for any single game shall not exceed 4 $150. 5 (Source: P.A. 87-220; 87-1175; 88-53.) 6 Section 99. Effective date. This Act takes effect upon 7 becoming law.
