Amend Senate Bill 172 as follows: 3 on page 4, by replacing lines 26 and 27 with the following: 4 "11-1201 of the Illinois Vehicle Code. You can elect to 5 proceed by:"; and 6 on page 4, by replacing lines 30 through 33 with the 7 following: 8 "Citation in court; or 9 3. If you were not the operator of the vehicle at the 10 time of the alleged offense, notifying in writing the 11 local law enforcement agency that issued the Uniform 12 Traffic Citation of the number of the Uniform Traffic 13 Citation received and the name and address of the person 14 operating the vehicle at the time of the alleged offense. 15 If you fail to so notify in writing the local law 16 enforcement agency of the name and address of the 17 operator of the vehicle at the time of the alleged 18 offense, you may be presumed to have been the operator of 19 the vehicle at the time of the alleged offense. 20 (d-2) If the registered owner of the vehicle was not the 21 operator of the vehicle at the time of the alleged offense, 22 and if the registered owner notifies the local law 23 enforcement agency having jurisdiction of the name and -2- LRB9201414ARsbam03 1 address of the operator of the vehicle at the time of the 2 alleged offense, the local law enforcement agency having 3 jurisdiction shall then issue a written Uniform Traffic 4 Citation to the person alleged by the registered owner to 5 have been the operator of the vehicle at the time of the 6 alleged offense. If the registered owner fails to notify in 7 writing the local law enforcement agency having jurisdiction 8 of the name and address of the operator of the vehicle at the 9 time of the alleged offense, the registered owner may be 10 presumed to have been the operator of the vehicle at the time 11 of the alleged offense." ; and 12 on page 5, by replacing lines 22 and 23 with the following: 13 "was in good working order at the beginning and the end of 14 the day of the alleged offense.Photographs or"; and 15 on page 5, by deleting lines 30 and 31; and 16 on page 6, line 24, by replacing "civil penalty" with 17 "violation of this Section is a petty offense for which a 18 fine"; and 19 on page 6, line 25, by deleting "of this Section"; and 20 on page 6, line 25, by replacing "civil penalty" with "fine"; 21 and 22 on page 6, by replacing lines 28 through 32 with the 23 following: 24 "(ii) For a second or subsequent violation, 25 the Secretary of State may suspend the registration 26 of the motor vehicle for a period of at least 6 27 months.".
