92_HJ0046ham001 LRB9209077RHrham04 1 AMENDMENT TO HOUSE JOINT RESOLUTION 46 2 AMENDMENT NO. . Amend House Resolution 46 by 3 replacing everything after the title with the following: 4 "WHEREAS, The General Assembly supports a single system 5 of early intervention services; and 6 WHEREAS, The General Assembly further supports the 7 sentiments set forth under the Federal Individuals with 8 Disabilities Education Act Part C, which established federal 9 financial assistance for states to develop and implement a 10 statewide, comprehensive, coordinated, multidisciplinary, 11 interagency system that provides early intervention services 12 to enhance the development of infants and toddlers with 13 disabilities and to minimize their potential for a 14 developmental delay; and 15 WHEREAS, Child development research has established that 16 the rate of human learning and development is most rapid in 17 the preschool years; and 18 WHEREAS, Research has also shown that early intervention 19 results in a child requiring fewer special education and 20 other habilitative services later in life and also reduces 21 the possibility of the child being held back in school; and -2- LRB9209077RHrham04 1 WHEREAS, In addition to enhancing the personal growth, 2 health, and opportunity of a child, the Early Intervention 3 Program, provides a long-term cost-savings of $5 to $7 in 4 special education costs for every $1 spent on early 5 intervention services per child; and 6 WHEREAS, The benefits of these services have recently 7 been jeopardized in Illinois by unanticipated growth in 8 enrollment, which has subsequently produced a shortfall in 9 funds for the program; and 10 WHEREAS, The legislature recognizes that in order to 11 maintain early intervention services for all eligible infants 12 and toddlers, and thus, continue to reap the full long-term 13 benefits these services provide, both for the child and the 14 State, the Department of Human Services must have a dedicated 15 source of support from members of the General Assembly; 16 therefore, be it 17 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE 18 NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 19 SENATE CONCURRING HEREIN, that the General Assembly shall 20 convene and administer a legislative advisory committee for 21 the Early Intervention Program; and be it further 22 RESOLVED, That the Early Intervention Legislative 23 Advisory Committee shall be responsible for providing support 24 and guidance to the managing body of the Early Intervention 25 Program within the Department of Human Services and shall be 26 further responsible for the following: 27 (1) serving as the representative body to which the 28 Department of Human Services reports on the progress of 29 implementing cost-containment strategies and the status 30 of the program; 31 (2) monitoring the ongoing implementation of 32 recommended cost-containment strategies; -3- LRB9209077RHrham04 1 (3) monitoring the Department's efforts in 2 utilizing all resources necessary to maintain and ensure 3 fiscal control without jeopardizing services to all 4 eligible infants and toddlers; 5 (4) assisting the Department in the development of 6 an early intervention long-term strategic plan outlining 7 outcome-based goals; and 8 (5) maintaining ongoing communication with the 9 Bureau of the Budget and the Office of the Governor 10 regarding the status of the program; and be it further 11 RESOLVED, That the Committee shall consist of a bicameral 12 and bipartisan membership totaling 8 members, with two 13 legislative members appointed by each Majority and Minority 14 Leader in the House and Senate, and shall also consist of a 15 representative from each of the following: the Department of 16 Human Services, the Department of Insurance, the Department 17 of Public Aid, and the University of Illinois at Chicago 18 Division of Specialized Care for Children; and be it further 19 RESOLVED, That the Department of Human Services shall be 20 responsible for reporting to the Early Intervention 21 Legislative Advisory Committee at least once a month 22 regarding the following information: 23 (1) number of children enrolled in the Early 24 Intervention Program; 25 (2) number of children covered by Medicaid/Kidcare 26 and the number of children who may be eligible for 27 Medicaid/Kidcare; 28 (3) number of children covered by private insurance 29 and the amount recovered by the Department in billing for 30 insurance; 31 (4) breakdown of enrollment by diagnosis (including 32 the number of children with a specific developmental 33 disability diagnosis); -4- LRB9209077RHrham04 1 (5) CFC/provider caseload; 2 (6) CFC funding breakdown; 3 (7) status of the data management system; 4 (8) status of the implementation of programmatic 5 rules and procedures; 6 (9) status of the IMDN quality assurance review 7 process; and 8 (10) any additional information requested by 9 members of the Legislative Advisory Committee; and be it 10 further 11 RESOLVED, That the Department of Human Services shall be 12 responsible for submitting an official interim report in 13 November 2001 and a final report in June 2002 to the Early 14 Intervention Legislative Advisory Committee, which must 15 include, but not be limited to, the following: 16 (1) all data provided in update reports; 17 (2) enrollment and cost projections for FY03 (with 18 rough estimates included in the November report and final 19 estimates to be included in the June report); 20 (3) status of the program's budget, including a 21 breakdown of funds collected through private insurance, 22 family fees, and Medicaid; 23 (4) identification of any programmatic concerns, 24 including strategies the Department is considering to 25 address these concerns; and 26 (5) any additional information requested by members 27 of the Legislative Advisory Committee; and be it further 28 RESOLVED, That suitable copies of this resolution be 29 delivered to the Secretary of Human Services and the 30 Associate Secretary in charge of the Early Intervention 31 Program.".
