92_HC0014 LRB9216563SMdv 1 HOUSE JOINT RESOLUTION 2 CONSTITUTIONAL AMENDMENT 3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE 4 NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 5 SENATE CONCURRING HEREIN, that there shall be submitted to 6 the electors of the State for adoption or rejection at the 7 general election next occurring at least 6 months after the 8 adoption of this resolution a proposition to amend Section 2 9 of Article VIII of the Illinois Constitution as follows: 10 ARTICLE VIII 11 FINANCE 12 (ILCON Art. VIII, Sec. 2) 13 SECTION 2. STATE FINANCE 14 (a) The Governor shall prepare and submit to the General 15 Assembly, at a time prescribed by law, a State budget for the 16 ensuing fiscal year. The budget shall set forth the estimated 17 balance of funds available for appropriation at the beginning 18 of the fiscal year, the estimated receipts, and a plan for 19 expenditures and obligations during the fiscal year of every 20 department, authority, public corporation and quasi-public 21 corporation of the State, every State college and university, 22 and every other public agency created by the State, but not 23 of units of local government or school districts. The budget 24 shall also set forth the indebtedness and contingent 25 liabilities of the State and such other information as may be 26 required by law. Proposed expenditures shall not exceed funds 27 estimated to be available for the fiscal year as shown in the 28 budget. 29 (b) The General Assembly by law shall make 30 appropriations for all expenditures of public funds by the 31 State. Appropriations for a fiscal year shall not exceed 32 funds estimated by the General Assembly to be available -2- LRB9216563SMdv 1 during that year. 2 (c) The aggregate of appropriations for the expenditure 3 of public funds by the State for a fiscal year shall not 4 exceed the aggregate of appropriations for the expenditure of 5 public funds by the State for the preceding fiscal year by 6 more than 3% or, if a cost of living index has been 7 designated by law for this purpose, the percentage increase 8 from the previous year in the cost of living based on that 9 index, whichever is less. The General Assembly may exceed the 10 limit on the aggregate appropriations for the expenditure of 11 public funds by the State for a fiscal year only by an 12 affirmative record vote of three-fifths of the members 13 elected to each house. 14 (Source: Illinois Constitution.) 15 SCHEDULE 16 This Constitutional Amendment takes effect upon being 17 declared adopted in accordance with Section 7 of the Illinois 18 Constitutional Amendment Act.
