1 AN ACT concerning procurement.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Procurement Code is amended by
5 changing Section 1-15.100 as follows:
6 (30 ILCS 500/1-15.100)
7 Sec. 1-15.100. State agency. "State agency" means and
8 includes all boards, commissions, agencies, institutions,
9 authorities, and bodies politic and corporate of the State,
10 created by or in accordance with the constitution or statute,
11 of the executive branch of State government and does include
12 colleges, universities, and institutions under the
13 jurisdiction of the governing boards of the University of
14 Illinois, Southern Illinois University, Illinois State
15 University, Eastern Illinois University, Northern Illinois
16 University, Western Illinois University, Chicago State
17 University, Governor State University, Northeastern Illinois
18 University, and the Board of Higher Education. The term also
19 includes the Metropolitan Transit Authority and the Regional
20 Transportation Authority. However, this term does not apply
21 to public employee retirement systems or investment boards
22 that are subject to fiduciary duties imposed by the Illinois
23 Pension Code or to the University of Illinois Foundation.
24 "State agency" does not include units of local government,
25 school districts, community colleges under the Public
26 Community College Act, and the Illinois Comprehensive Health
27 Insurance Board.

29 Section 10. The Metropolitan Transit Authority Act is
30 amended by adding Section 32.5 as follows:

1 (70 ILCS 3605/32.5 new)
2 Sec. 32.5. Illinois Procurement Code. Notwithstanding any
3 other provision of this Act to the contrary, this Act is
4 subject to the Illinois Procurement Code.
5 Section 15. The Regional Transportation Authority Act is
6 amended by adding Section 4.06-5 as follows:
7 (70 ILCS 3615/4.06-5 new)
8 Sec. 4.06-5. Illinois Procurement Code. Notwithstanding
9 any other provision of this Act to the contrary, this Act is
10 subject to the Illinois Procurement Code.
11 Section 99. Effective date. This Act takes effect upon
12 becoming law.
