92_HB5911enr HB5911 Enrolled LRB9215050BDtm 1 AN ACT concerning the Illinois Century Network. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Century Network Act is amended 5 by changing Sections 10, 15, and 20 and by adding Section 25 6 as follows: 7 (20 ILCS 3921/10) 8 Sec. 10. Illinois Century Network. The Illinois Century 9 Network shall be a service creating and maintaining high 10 speed telecommunications networksnetworkthat provide 11providesreliable communication links to and among Illinois 12 schools, institutions of higher education, libraries, 13 museums, research institutions, State agencies, units of 14 local government, and other local entities that provide 15 services to Illinois citizens. The Illinois Century Network 16 shall build on existing investments in networking schools, 17 colleges, and universities, avoid duplication of future 18 efforts, maintain sufficient capacity to meet the 19 requirements of the participating institutions, and stay 20 current with rapid developments in technology. The Illinois 21 Century Network shall be capable of delivering 22 state-of-the-art access to education, training, and 23 electronic information and shall provide access to networking 24 technologies for institutions located in even the most remote 25 areas of this State. 26 (Source: P.A. 91-21, eff. 7-1-99.) 27 (20 ILCS 3921/15) 28 Sec. 15. Management of the Illinois Century Network. 29 (a) Staffing and contractual services necessary to 30 support the network's activities shall be governed by the HB5911 Enrolled -2- LRB9215050BDtm 1 Illinois Century Network Policy Committee. The committee 2 shall include: 3 (1) 6 standing members as follows: 4 (i) the Illinois State Library Director or 5 designee; 6 (ii) the Illinois State Museum Director or 7 designee; 8 (iii) the Executive Director of the Board of 9 Higher Education or designee; 10 (iv) the Community College Board President or 11 designee; 12 (v) the State Board of Education State 13 Superintendent or designee; and 14 (vi) the Director of Central Management 15 Services or designee; 16 (2) up to 7 members who are appointed by the 17 Governor and who: 18 (i) have experience and background in private 19 K-12 education, private higher education, or who are 20 from other participant constituents that are not 21 already represented; 22 (ii) shall serve staggered terms up to 3 years 23 as designated by the Governor; and 24 (iii) shall serve until a successor is 25 appointed and qualified; and 26 (3) a Chairperson who is appointed by the Governor 27 and who shall serve a term of 2 years and until a 28 successor is appointed and qualified. 29 (b) Illinois Century Network Policy Committee members 30 shall serve without compensation but shall be entitled to 31 reimbursement for reasonable expenses of travel for members 32 who are required to travel for a distance greater than 20 33 miles to participate in business of the Illinois Century 34 Network Policy Committee.provided by the Board of HigherHB5911 Enrolled -3- LRB9215050BDtm 1Education, the Illinois Community College Board, the State2Board of Education, and other agencies as necessary or3warranted, using funds appropriated to these agencies for4this purpose.5 (Source: P.A. 91-21, eff. 7-1-99.) 6 (20 ILCS 3921/20) 7 Sec. 20. Illinois Century Network Policy Committee. The 8 Illinois Century Network Policy Committee shall set general 9 policies for the network. The Committee shall have the 10 following additional duties and powers: 11 (1) to purchase, acquire, or receive equipment and 12 agreements or contracts for services for the benefit of 13 the Illinois Century Network or its participants; 14 (2) to sell or convey equipment or services 15 desirable for Network operations to its participants at 16 reasonable costs incurred in the acquisition of the 17 equipment or services; 18 (3) to employ and fix the compensation for 19 employees as it deems reasonable to achieve the purposes 20 of this Act; 21 (4) to establish and maintain petty cash funds as 22 provided in Section 13.3 of the State Finance Act; 23 (5) to make, amend, and repeal bylaws, rules, 24 regulations, and resolutions that are consistent with 25 this Act; 26 (6) to make and execute all contracts and 27 instruments necessary or convenient to the exercise of 28 its powers; 29 (7) to exclusively control and manage the Network 30 and all moneys that are donated, paid, or appropriated 31 for the creation, improvement, and operation of the 32 Network; 33 (8) to prepare and submit a budget for the HB5911 Enrolled -4- LRB9215050BDtm 1 necessary and contingent operation expenses of the 2 Network; 3 (9) to accept grants and funds from the federal and 4 state governments and any federal or state agency and to 5 expend those moneys in accordance and in furtherance of 6 the purposes of this Act; 7 (10) to enter into intergovernmental agreements 8 with other governmental entities, including but not 9 limited to, the Board of Higher Education, the Illinois 10 Community College Board, the State Board of Education, 11 the Department of Central Management Services, and local 12 education agencies, in order to implement and execute the 13 powers and duties set forth in this Act; 14 (11) to acquire or procure telecommunications or 15 computer networks or related services, alone or in 16 cooperation with other governmental or education 17 entities, as may be of reasonable benefit to the Network 18 or its participants for the general purposes set forth in 19 this Act; and 20 (12) to receive assignment of ownership or 21 management rights and the use of telecommunications 22 equipment and services owned or leased by the State of 23 Illinois or other entities providing services to Illinois 24 citizens for use in operation of Network programs and 25 services.consist of representatives from (i) the Office26of the Governor, appointed by the Governor, (ii) the27Board of Higher Education, appointed by the Board of28Higher Education, (iii) the Illinois Community College29Board, appointed by the Illinois Community College Board,30(iv) the State Board of Education, appointed by the State31Board of Education, and (v) other public and private32partners as are necessary, appointed by the Governor.33 (Source: P.A. 91-21, eff. 7-1-99.) HB5911 Enrolled -5- LRB9215050BDtm 1 (20 ILCS 3921/25 new) 2 Sec. 25. Illinois Century Network Special Purposes Fund. 3 There is hereby created the Illinois Century Network Special 4 Purposes Fund within the State treasury. Deposits into the 5 Fund shall include but not be limited to any funds 6 appropriated to State agencies for the operation of the 7 Network, funds collected as reimbursements, fees for network 8 partnerships, and federal funds. Deposits into the Fund 9 shall include any gifts, grants, or donations received by the 10 network from any public or private organization including 11 State and federal agencies. Earnings attributable to moneys 12 in the Illinois Century Network Special Purposes Fund shall 13 be deposited into the Fund. Subject to appropriation, all 14 moneys within the Fund shall be expended for the operation of 15 the Illinois Century Network, including building and 16 maintaining the Network and its supporting connections. 17 Section 10. The State Finance Act is amended by adding 18 Section 5.570 as follows: 19 (30 ILCS 105/5.570 new) 20 Sec. 5.570. The Illinois Century Network Special 21 Purposes Fund. 22 Section 99. Effective date. This Act takes effect upon 23 becoming law.
