 1                    AMENDMENT TO HOUSE BILL 5823

 2        AMENDMENT NO.     .  Amend House Bill 5823  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The  Service Men's Employment Tenure Act is
 5    amended by changing Section  1  and  adding  Section  5.3  as
 6    follows:

 7        (330 ILCS 60/1) (from Ch. 126 1/2, par. 29)
 8        Sec. 1.  Short title.  This Act shall be known and may be
 9    cited as the Service Men's Employment Tenure and Civil Relief
10    Act.

12        (330 ILCS 60/5.3 new)
13        Sec.   5.3.  Illinois   National   Guard;  Soldiers'  and
14    Sailors' Civil Relief Act of 1940.
15        (a)  Notwithstanding any other provision of law, a person
16    who is a member of the Illinois National  Guard  and  who  is
17    called  to  active status shall be accorded all of the rights
18    and privileges under the laws of this State that are accorded
19    to  federal  military  personnel  under  the  Soldiers'   and
20    Sailors'  Civil  Relief  Act  of  1940,  as  now or hereafter
21    amended, if the person called to active status complies  with

 1    the notice procedures set forth in the Soldiers' and Sailors'
 2    Civil Relief Act of 1940.
 3        (b)  Notwithstanding any other provision of law, a person
 4    who  is a member of the federal military and who is called to
 5    active status  shall  be  accorded  all  of  the  rights  and
 6    privileges  under the laws of this State that are accorded to
 7    the person under the Soldiers' and Sailors' Civil Relief  Act
 8    of 1940, as now or hereafter amended, if the person called to
 9    active  status  complies with the notice procedures set forth
10    in the Soldiers' and Sailors' Civil Relief Act of 1940.
11        (c)  A person who has provided  notice  under  subsection
12    (a) or (b) shall, within 60 days after the termination of his
13    or   her   active  status,  provide  written  notice  of  the
14    termination of his or her active status to the person to whom
15    notice was provided under subsection (a) or (b).

16        Section 99.  Effective date. This Act takes  effect  upon
17    becoming law.".
