92_HB5648 LRB9214591RCcd 1 AN ACT in relation to criminal law. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Code of 1961 is amended by 5 adding Section 21-8 as follows: 6 (720 ILCS 5/21-8 new) 7 Sec. 21-8. Criminal trespass to a nuclear facility. 8 (a) A person commits the offense of criminal trespass to 9 a nuclear facility if he or she knowingly and without lawful 10 authority: 11 (1) enters or remains within a nuclear facility or 12 on the grounds of a nuclear facility, after receiving 13 notice before entry that entry to the nuclear facility is 14 forbidden; or 15 (2) remains within the facility or on the grounds 16 of the facility after receiving notice from the owner 17 or manager of the facility or other person authorized by 18 the owner or manager of the facility to give that notice 19 to depart from the facility or grounds of the facility. 20 (b) A person has received notice from the owner or 21 manager of the facility or other person authorized by the 22 owner or manager of the facility within the meaning of 23 subsection (a) if he or she has been notified personally, 24 either orally or in writing, or if a printed or written 25 notice forbidding the entry has been conspicuously posted or 26 exhibited at the main entrance to the facility or grounds of 27 the facility or the forbidden part of the facility. 28 (c) In this Section, "nuclear facility" has the meaning 29 ascribed to it in Section 3 of the Illinois Nuclear Safety 30 Preparedness Act. 31 (d) Sentence. Criminal trespass to a nuclear facility is -2- LRB9214591RCcd 1 a Class 4 felony.
