92_HB5593enr HB5593 Enrolled LRB9212652REpk 1 AN ACT concerning land. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. Association for Individual Development; PADS; 5 Kane County; right of entry. 6 (a) In Article I of Public Act 81-910, effective January 7 1, 1980, the Director of Mental Health and Developmental 8 Disabilities, predecessor of the Secretary of Human Services, 9 was authorized to convey 18 acres, more or less, in Kane 10 County, Illinois, described in Section 1-1 of Public Act 11 81-910, to the Association for Individual Development, 12 subject to the condition that the real property be used for 13 purposes authorized by the bylaws of the Association on 14 January 1, 1980. Section 1-6 of Public Act 81-910 provides 15 that the State of Illinois has a right of entry for condition 16 broken if the Association neglects or fails to use the lands 17 for those purposes. 18 (b) The State of Illinois waives and releases its right 19 of entry with respect to part of the land described in 20 Section 1-1 of Public Act 81-910 to allow the Association to 21 convey or otherwise transfer 2.5 acres and an easement to 22 P.A.D.S. of Elgin, Inc. free and clear of the State's right 23 of entry. The balance of the land, however, continues to be 24 subject to the State's right of entry. 25 (c) The 2.5 acres and easement referred to in subsection 26 (b) are described as follows: 27 That part of the Southeast Quarter of Section 23 and 28 part of the Southwest Quarter of Section 24, Township 41 29 North, Range 8 East of the Third Principal Meridian, 30 described as follows: Commencing at the point of 31 intersection of the South line of the North 983.40 feet 32 of Section 26, Township and Range aforesaid, with the HB5593 Enrolled -2- LRB9212652REpk 1 Southeasterly line of the right of way of Illinois State 2 Route No. 31; thence Northeasterly along said 3 Southeasterly line 1544.41 feet; thence Easterly along a 4 line forming an angle of 109 degrees 48 minutes 48 5 seconds with a line drawn tangent to the last described 6 course at the last described point (measured 7 counterclockwise therefrom), 46.75 feet to the present 8 Easterly right of way line of State Route 31 to a point 9 hereinafter known as Point "A"; thence Easterly along the 10 last described line (hereinafter known as Line "A") 11 764.34 feet for the point of beginning; thence Northerly 12 along a line forming an angle of 94 degrees O8 minutes 06 13 seconds measured clockwise from the last described line, 14 a distance of 330.46 feet; thence Westerly along a line 15 forming an angle of 85 degrees 51 minutes 54 seconds 16 measured clockwise from the last described line (being 17 parallel to said Line "A"), a distance of 330.40 feet; 18 thence Southerly along a line forming an angle of 94 19 degrees 08 minutes 06 seconds measured clockwise from the 20 last described line, 330.46 feet to said Line "A"; thence 21 Easterly along said Line "A" 330.40 feet to the point of 22 beginning, containing 2.5000 Acres, in Elgin Township, 23 Kane County, Illinois. 24 ALSO, a 33.0 foot Easement for ingress and egress 25 described as follows: Beginning at Point "A" aforesaid; 26 thence Easterly along Line "A" aforesaid 433.94 feet; 27 thence Northerly along a line forming an angle of 94 28 degrees 08 minutes O6 seconds measured clockwise from the 29 last described line 33.09 feet; thence Westerly along a 30 line 33.0 feet North of and parallel with said Line "A" 31 424.59 feet to the Easterly right of way of State Route 32 31; thence Southerly along said right of way line being 33 on a curve to the right having a radius of 8262.16 feet, 34 an arc distance of 35.03 feet to the point of beginning, HB5593 Enrolled -3- LRB9212652REpk 1 in Elgin Township, Kane County, Illinois. 2 (d) The Secretary of Human Services shall obtain a 3 certified copy of the portions of this Act containing the 4 title, the enacting clause, the effective date, and this 5 Section within 60 days after the effective date of this Act 6 and shall record the certified document in the Recorder's 7 Office in Kane County, Illinois. 8 Section 99. Effective date. This Act takes effect on 9 January 1, 2003.
