92_HB5523 LRB9211495WHcs 1 AN ACT in relation to veterans homes. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Department of Veterans Affairs Act is 5 amended by changing Section 2.01 as follows: 6 (20 ILCS 2805/2.01) (from Ch. 126 1/2, par. 67.01) 7 Sec. 2.01. Veterans homes. Any honorably discharged 8 veteran is entitled to admission to an Illinois Veterans 9 Home, if the applicant: 10 (a) (1) Has served in the armed forces of the United 11 States at least one1day in the Spanish American War, World 12 War I, World War II, the Korean Conflict, the Viet Nam 13 Campaign, or the Persian Gulf Conflict between the dates 14 recognized by the U.S. Department of Veterans Affairs or 15 between any other present or future dates recognized by the 16 U.S. Department of Veterans Affairs as a war period, or has 17 served in a hostile fire environment and has been awarded a 18 campaign or expeditionary medal signifying his or her 19 service, for purposes of eligibility for domiciliary or 20 nursing home care; or 21 (2) Has (i) served on active duty in the armed forces 22 for one year for purposes of eligibility for domiciliary care 23 only or (ii) served in the National Guard or Reserve Forces 24 of the United States and completed 20 years of satisfactory 25 service, is otherwise eligible to receive reserve or active 26 duty retirement benefits, and has been an Illinois resident 27 for at least one year before applying for admission for 28 purposes of eligibility for domiciliary care only; and 29 (b) Has service accredited to the State of Illinois or 30 has been a resident of this State for one year immediately 31 preceding the date of application; and -2- LRB9211495WHcs 1 (c) For admission to the Illinois Veterans Homes at Anna 2 and Quincy, is disabled by disease, wounds, or otherwise and 3 because of the disability is incapable of earning a living; 4 or 5 (d) For admission to the Illinois Veterans Homes at 6 LaSalle and Manteno and for admission to the John Joseph 7 Kelly Veteran's Home, is disabled by disease, wounds, or 8 otherwise and, for purposes of eligibility for nursing home 9 care, requires nursing care because of the disability. 10 (Source: P.A. 91-634, eff. 8-19-99; 92-351, eff. 1-1-02.)
