92_HB5520 LRB9211496WHcs 1 AN ACT concerning veterans. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Veterans Preference Act is amended by 5 changing Section 1 as follows: 6 (330 ILCS 55/1) (from Ch. 126 1/2, par. 23) 7 Sec. 1. In the employment and appointment to fill 8 positions in the construction, addition to, or alteration of 9 all public works undertaken or contracted for by the State, 10 or by any political subdivision of the Statethereof, 11 preference shall be given to persons who have been members of 12 the armed forces of the United States or who, while citizens 13 of the United States, were members of the armed forces of 14 allies of the United States in time of hostilities with a 15 foreign country, and have served under one or more of the 16 following conditions: 17 (1) The veteran served a total of at least 6 18 months, or 19 (2) The veteran served for the duration of 20 hostilities regardless of the length of engagement, or 21 (3) The veteran served in the theater of operations 22 but was discharged on the basis of a hardship, or 23 (4) The veteran was released from active duty 24 because of a service connected disability and was 25 honorably discharged. But such preference shall be given 26 only to those persons who are found to possess the 27 business capacity necessary for the proper discharge of 28 the duties of such employment. No political subdivision 29 or person contracting for such public works is required 30 to give preference to veterans, not residents of such 31 district, over residents thereof, who are not veterans. -2- LRB9211496WHcs 1 As used in this Section: 2 "Time of hostilities with a foreign country" means 3 any period of time in the past, present, or future during 4 which a declaration of war by the United States Congress 5 has been or is in effect or during which an emergency 6 condition has been or is in effect that is recognized by 7 the issuance of a Presidential proclamation or a 8 Presidential executive order and in which the armed 9 forces expeditionary medal or other campaign service 10 medals are awarded according to Presidential executive 11 order. 12 "Armed forces of the United States" means the United 13 States Army, Navy, Air Force, Marine Corps, Coast Guard. 14 Service in the Merchant Marine that constitutes active 15 duty under Section 401 of federal Public Law 95-202 shall 16 also be considered service in the Armed Forces of the 17 United States for purposes of this Section. 18 (Source: P.A. 87-796.)
