92_HB5281eng HB5281 Engrossed LRB9211646ACcd 1 AN ACT in relation to the regulation of professions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Nursing and Advanced Practice Nursing Act 5 is amended by changing Section 20-40 as follows: 6 (225 ILCS 65/20-40) 7 (Section scheduled to be repealed on January 1, 2008) 8 Sec. 20-40. Fund. There is hereby created within the 9 State Treasury the Nursing Dedicated and Professional Fund. 10 The monies in the Fund may be used by and at the direction of 11 the Department for the administration and enforcement of this 12 Act, including but not limited to: 13 (a) Distribution and publication of the Nursing and 14 Advanced Practice Nursing Act and the rules at the time 15 of renewal to all persons licensed by the Department 16 under this Act. 17 (b) Employment of secretarial, nursing, 18 administrative, enforcement, and other staff for the 19 administration of this Act. 20 (c) Conducting a survey, as prescribed by rule of 21 the Department, once every 4 years during the license 22 renewal period. 23 (d) Conducting of training seminars for licensees 24 under this Act relating to the obligations, 25 responsibilities, enforcement and other provisions of the 26 Act and its rules. 27 (d-5) Establishment of a nursing image program to 28 educate the general public about the critical role nurses 29 play in the delivery of health services to result in the 30 recruitment of a greater number of persons entering the 31 profession. The program established by the Department HB5281 Engrossed -2- LRB9211646ACcd 1 shall be developed and implemented in collaboration with 2 the Illinois Nurses Association and the Illinois 3 Coalition for Nursing Resources. 4 (e) Disposition of Fees: 5 (i) (Blank). 6 (ii) All of the fees and fines collected 7 pursuant to this Act shall be deposited in the 8 Nursing Dedicated and Professional Fund. 9 (iii) For the fiscal year beginning July 1, 10 1988, the moneys deposited in the Nursing Dedicated 11 and Professional Fund shall be appropriated to the 12 Department for expenses of the Department and the 13 Board in the administration of this Act. All 14 earnings received from investment of moneys in the 15 Nursing Dedicated and Professional Fund shall be 16 deposited in the Nursing Dedicated and Professional 17 Fund and shall be used for the same purposes as fees 18 deposited in the Fund. 19 (iv) For the fiscal year beginning July 1, 20 2001 and for each fiscal year thereafter, $750,000 21 of the moneys deposited in the Nursing Dedicated and 22 Professional Fund each year shall be set aside and 23 appropriated to the Illinois Department of Public 24 Health for nursing scholarships awarded pursuant to 25 the Nursing Education Scholarship Law. 26 Representatives of the Department and the Nursing 27 Education Scholarship Program Advisory Council shall 28 review this requirement and the scholarship awards 29 every 2 years. 30 (iv-5) For the fiscal year beginning July 1, 31 2002, $3,500,000 of the moneys deposited into the 32 Nursing Dedicated and Professional Fund shall be 33 appropriated to the Department to be used within 2 34 fiscal years of the effective date of this HB5281 Engrossed -3- LRB9211646ACcd 1 amendatory Act of the 92nd General Assembly to 2 accomplish the goals set forth in subsection (d-5) 3 of this Section. 4 (v) Moneys in the Fund may be transferred to 5 the Professions Indirect Cost Fund as authorized 6 under Section 2105-300 of the Department of 7 Professional Regulation Law (20 ILCS 2105/2105-300). 8 (Source: P.A. 91-239, 1-1-00; 92-46, eff. 7-1-01.) 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.
