Amend House Bill 5222 by replacing 3 the title with the following: 4 "AN ACT in relation to vehicles."; and 5 by replacing everything after the enacting clause with the 6 following: 7 "Section 5. The Illinois Vehicle Code is amended by 8 re-enacting Section 6-301 and changing Sections 6-601 and 9 15-107 as follows: 10 (625 ILCS 5/6-301) (from Ch. 95 1/2, par. 6-301) 11 Sec. 6-301. Unlawful use of license or permit. 12 (a) It is a violation of this Section for any person: 13 1. To display or cause to be displayed or have in 14 his possession any cancelled, revoked or suspended 15 license or permit; 16 2. To lend his license or permit to any other 17 person or knowingly allow the use thereof by another; 18 3. To display or represent as his own any license 19 or permit issued to another; 20 4. To fail or refuse to surrender to the Secretary 21 of State or his agent or any peace officer upon his -2- LRB9211478DHcsam 1 lawful demand, any license or permit, which has been 2 suspended, revoked or cancelled; 3 5. To allow any unlawful use of a license or permit 4 issued to him; 5 6. To submit to an examination or to obtain the 6 services of another person to submit to an examination 7 for the purpose of obtaining a drivers license or permit 8 for some other person. 9 (b) Sentence. 10 1. Any person convicted of a violation of this 11 Section shall be guilty of a Class A misdemeanor and 12 shall be sentenced to a minimum fine of $500 or 50 hours 13 of community service, preferably at an alcohol abuse 14 prevention program, if available. 15 2. Any person convicted of a second or subsequent 16 violation of this Section shall be guilty of a Class 4 17 felony. 18 3. In addition to any other sentence imposed under 19 paragraph 1 or 2 of this subsection (b), a person 20 convicted of a violation of paragraph 6 of subsection (a) 21 shall be imprisoned for not less than 7 days. 22 (c) This Section does not prohibit any lawfully 23 authorized investigative, protective, law enforcement or 24 other activity of any agency of the United States, State of 25 Illinois or any other state or political subdivision thereof. 26 (d) This Section does not apply to licenses and permits 27 invalidated under Section 6-301.3 of this Code. 28 (Source: P.A. 92-647, eff. 1-1-03.) 29 (625 ILCS 5/6-601) (from Ch. 95 1/2, par. 6-601) 30 (Text of Section from P.A. 92-622) 31 Sec. 6-601. Penalties. 32 (a) It is a petty offense for any person to violate any 33 of the provisions of this Chapter unless such violation is by -3- LRB9211478DHcsam 1 this Code or other law of this State declared to be a 2 misdemeanor or a felony. 3 (b) General penalties. Unless another penalty is in 4 this Code or other laws of this State, every person convicted 5 of a petty offense for the violation of any provision of this 6 Chapter shall be punished by a fine of not more than $500. 7 (c) Unlicensed driving. Except as hereinafter provided 8 a violation of Section 6-101 shall be: 9 1. A Class A misdemeanor if the person failed to 10 obtain a driver's license or permit after expiration of a 11 period of revocation. 12 2. A Class B misdemeanor if the person has been 13 issued a driver's license or permit, which has expired, 14 and if the period of expiration is greater than one year; 15 or if the person has never been issued a driver's license 16 or permit, or is not qualified to obtain a driver's 17 license or permit because of his age. 18 If a licensee under this Code is convicted of violating 19 Section 6-101 for operating a motor vehicle during a time 20 when such licensee's driver's license was invalid under the 21 provisions of Section 6-110, then conviction under such 22 circumstances shall be punishable by a fine of not more than 23 $25. 24 If a licensee under this Code is convicted of violating 25 Section 6-303 for operating a motor vehicle during a time 26 when such licensee's driver's license was suspended under the 27 provisions of Section 6-306.3, then such act shall be a petty 28 offense (provided the licensee has answered the charge which 29 was the basis of the suspension under Section 6-306.3), and 30 there shall be imposed no additional like period of 31 suspension as provided in paragraph (b) of Section 6-303. 32Any person convicted of a violation of subsection 6 of33Section 6-301 shall be guilty of a Class B misdemeanor and34shall be imprisoned for not less than 7 days.-4- LRB9211478DHcsam 1 (Source: P.A. 92-622, eff. 1-1-03.) 2 (Text of Section from P.A. 92-647) 3 Sec. 6-601. A Class B misdemeanor if the person has been 18 issued a driver's license or permit, which has expired, 19 and if the period of expiration is greater than one year 206 months; or if the person has never been issued a 21 driver's license or permit, or is not qualified to obtain 22 a driver's license or permit because of his age. 23 If a licensee under this Code is convicted of violating 24 Section 6-101 for operating a motor vehicle during a time 25 when such licensee's driver's license was invalid under the 26 provisions of Section 6-110, then conviction under such 27 circumstances shall be punishable by a fine of not more than 28 $25. 29 If a licensee under this Code is convicted of violating 30 Section 6-303 for operating a motor vehicle during a time 31 when such licensee's driver's license was suspended under the 32 provisions of Section 6-306.3, then such act shall be a petty 33 offense (provided the licensee has answered the charge which 34 was the basis of the suspension under Section 6-306.3), and -5- LRB9211478DHcsam 1 there shall be imposed no additional like period of 2 suspension as provided in paragraph (b) of Section 6-303. 3 (Source: P.A. 92-647, eff. 1-1-03.) 4 (625 ILCS 5/15-107) (from Ch. 95 1/2, par. 15-107) 5 Sec. 15-107. Length of vehicles. 6 (a) The maximum length of a single vehicle on any 7 highway of this State may not exceed 42 feet except the 8 following: 9 (1) Semitrailers. 10 (2) Charter or regulated route buses may be up to 11 45 feet in length, not including energy absorbing 12 bumpers. 13 (a-1) A motor home as defined in Section 1-145.01 may be 14 up to 45 feet in length, not including energy absorbing 15 bumpers. The length limitations described in this subsection 16 (a-1) shall be exclusive of energy-absorbing bumpers and rear 17 view mirrors. 18 (b) On all non-State highways, the maximum length of 19 vehicles in combinations is as follows: 20 (1) A truck tractor in combination with a 21 semitrailer may not exceed 55 feet overall dimension. 22 (2) A truck tractor-semitrailer-trailer may not 23 exceed 60 feet overall dimension. 24 (3) Combinations specially designed to transport 25 motor vehicles or boats may not exceed 60 feet overall 26 dimension. 27 Vehicles operating during daylight hours when 28 transporting poles, pipes, machinery, or other objects of a 29 structural nature that cannot readily be dismembered are 30 exempt from length limitations, provided that no object may 31 exceed 80 feet in length and the overall dimension of the 32 vehicle including the load may not exceed 100 feet. This 33 exemption does not apply to operation on a Saturday, Sunday, -6- LRB9211478DHcsam 1 or legal holiday. Legal holidays referred to in this Section 2 are the days on which the following traditional holidays are 3 celebrated: New Year's Day; Memorial Day; Independence Day; 4 Labor Day; Thanksgiving Day; and Christmas Day. 5 Vehicles and loads operated by a public utility while en 6 route to make emergency repairs to public service facilities 7 or properties are exempt from length limitations, provided 8 that during night operations every vehicle and its load must 9 be equipped with a sufficient number of clearance lamps on 10 both sides and marker lamps on the extreme ends of any 11 projecting load to clearly mark the dimensions of the load. 12 A tow truck in combination with a disabled vehicle or 13 combination of disabled vehicles, as provided in paragraph 14 (6) of subsection (c) of this Section, is exempt from length 15 limitations. 16 All other combinations not listed in this subsection (b) 17 may not exceed 60 feet overall dimension. 18 (c) Combinations of vehicles may not exceed a total of 2 19 vehicles except the following: 20 (1) A truck tractor semitrailer may draw one 21 trailer. 22 (2) A truck tractor semitrailer may draw one 23 converter dolly. 24 (3) A truck tractor semitrailer may draw one 25 vehicle that is defined in Chapter 1 as special mobile 26 equipment, provided the overall dimension does not exceed 27 60 feet. 28 (4) A truck in transit may draw 3 trucks in transit 29 coupled together by the triple saddlemount method. 30 (5) Recreational vehicles consisting of 3 vehicles, 31 provided the following: 32 (A) The total overall dimension does not 33 exceed 60 feet. 34 (B) The towing vehicle is a properly -7- LRB9211478DHcsam 1 registered vehicle capable of towing another vehicle 2 using a fifth-wheel type assembly. 3 (C) The second vehicle in the combination of 4 vehicles is a recreational vehicle that is towed by 5 a fifth-wheel assembly. This vehicle must be 6 properly registered and must be equipped with 7 brakes, regardless of weight. 8 (D) The third vehicle must be the lightest of 9 the 3 vehicles and be a trailer or semitrailer 10 designed or used for transporting a boat, 11 all-terrain vehicle, personal watercraft, or 12 motorcycle. 13 (E) The towed vehicles may be only for the use 14 of the operator of the towing vehicle. 15 (F) All vehicles must be properly equipped 16 with operating brakes and safety equipment required 17 by this Code, except the additional brake 18 requirement in subdivision (C) of this subparagraph 19 (5). 20 (6) A tow truck in combination with a disabled 21 vehicle or combination of disabled vehicles, provided the 22 towing vehicle: 23 (A) Is specifically designed as a tow truck 24 having a gross vehicle weight rating of at least 25 18,000 pounds and equipped with air brakes, provided 26 that air brakes are required only if the towing 27 vehicle is towing a vehicle, semitrailer, or 28 tractor-trailer combination that is equipped with 29 air brakes. For the purpose of this subsection, 30 gross vehicle weight rating, or GVWR, means the 31 value specified by the manufacturer as the loaded 32 weight of the tow truck. 33 (B) Is equipped with flashing, rotating, or 34 oscillating amber lights, visible for at least 500 -8- LRB9211478DHcsam 1 feet in all directions. 2 (C) Is capable of utilizing the lighting and 3 braking systems of the disabled vehicle or 4 combination of vehicles. 5 (D) Does not engage a tow exceeding 50 highway 6 miles from the initial point of wreck or disablement 7 to a place of repair. Any additional movement of the 8 vehicles may occur only upon issuance of 9 authorization for that movement under the provisions 10 of Sections 15-301 through 15-319 of this Code. 11 The Department may by rule or regulation prescribe 12 additional requirements regarding length limitations for a 13 tow truck towing another vehicle. 14 For purposes of this Section, a tow-dolly that merely 15 serves as substitute wheels for another legally licensed 16 vehicle is considered part of the licensed vehicle and not a 17 separate vehicle. 18 (d) On Class I highways there are no overall length 19 limitations on motor vehicles operating in combinations 20 provided: 21 (1) The length of a semitrailer, unladen or with 22 load, in combination with a truck tractor may not exceed 23 53 feet. 24 (2) The distance between the kingpin and the center 25 of the rear axle of a semitrailer longer than 48 feet, in 26 combination with a truck tractor, may not exceed 45 feet 27 6 inches. 28 (3) The length of a semitrailer or trailer, unladen 29 or with load, operated in a truck 30 tractor-semitrailer-trailer combination, may not exceed 31 28 feet 6 inches. 32 (4) Maxi-cube combinations, as defined in Chapter 33 1, may not exceed 65 feet overall dimension. 34 (5) Combinations of vehicles specifically designed -9- LRB9211478DHcsam 1 to transport motor vehicles or boats may not exceed 65 2 feet overall dimension. The length limitation is 3 inclusive of front and rear bumpers but exclusive of the 4 overhang of the transported vehicles, as provided in 5 paragraph (i) of this Section. 6 (6) Stinger steered semitrailer vehicles as defined 7 in Chapter 1, specifically designed to transport motor 8 vehicles or boats, may not exceed 75 feet overall 9 dimension. The length limitation is inclusive of front 10 and rear bumpers but exclusive of the overhang of the 11 transported vehicles, as provided in paragraph (i) of 12 this Section. 13 (7) A truck in transit transporting 3 trucks 14 coupled together by the triple saddlemount method may not 15 exceed 75 feet overall dimension. 16 Vehicles operating during daylight hours when 17 transporting poles, pipes, machinery, or other objects of a 18 structural nature that cannot readily be dismembered are 19 exempt from length limitations, provided that no object may 20 exceed 80 feet in length and the overall dimension of the 21 vehicle including the load may not exceed 100 feet. Legal holidays referred to in this Section 24 are the days on which the following traditional holidays are 25 celebrated: New Year's Day; Memorial Day; Independence Day; 26 Labor Day; Thanksgiving Day; and Christmas Day. 27 Vehicles and loads operated by a public utility while en 28 route to make emergency repairs to public service facilities 29 or properties are exempt from length limitations, provided 30 that during night operations every vehicle and its load must 31 be equipped with a sufficient number of clearance lamps on 32 both sides and marker lamps on the extreme ends of any 33 projecting load to clearly mark the dimensions of the load. 34 A tow truck in combination with a disabled vehicle or -10- LRB9211478DHcsam 1 combination of disabled vehicles, as provided in paragraph 2 (6) of subsection (c) of this Section, is exempt from length 3 limitations. 4 The length limitations described in this paragraph (d) 5 shall be exclusive of safety and energy conservation devices, 6 such as bumpers, refrigeration units or air compressors and 7 other devices, that the Department may interpret as necessary 8 for safe and efficient operation; except that no device 9 excluded under this paragraph shall have by its design or use 10 the capability to carry cargo. 11 Section 5-35 of the Illinois Administrative Procedure Act 12 relating to procedures for rulemaking shall not apply to the 13 designation of highways under this paragraph (d). 14 (e) On Class II highways there are no overall length 15 limitations on motor vehicles operating in combinations, 16 provided: 17 (1) The length of a semitrailer, unladen or with 18 load, in combination with a truck tractor, may not exceed 19 53 feet overall dimension. 20 (2) The distance between the kingpin and the center 21 of the rear axle of a semitrailer longer than 48 feet, in 22 combination with a truck tractor, may not exceed 45 feet 23 6 inches. 24 (3) A truck tractor-semitrailer-trailer combination 25 may not exceed 65 feet inoveralldimension from front 26 axle to rear axle. 27 (4) The length of a semitrailer or trailer, unladen 28 or with load, operated in a truck 29 tractor-semitrailer-trailer combination, may not exceed 30 28 feet 6 inches. 31 (5) Maxi-cube combinations, as defined in Chapter 32 1, may not exceed 65 feet overall dimension. 33 (6) A combination of vehicles, specifically 34 designed to transport motor vehicles or boats, may not -11- LRB9211478DHcsam 1 exceed 65 feet overall dimension. The length limitation 2 is inclusive of front and rear bumpers but exclusive of 3 the overhang of the transported vehicles, as provided in 4 paragraph (i) of this Section. 5 (7) Stinger steered semitrailer vehicles, as 6 defined in Chapter 1, specifically designed to transport 7 motor vehicles or boats, may not exceed 75 feet overall 8 dimension. projecting load to clearly mark the dimensions of the load. 33 A tow truck in combination with a disabled vehicle or 34 combination of disabled vehicles, as provided in paragraph -12- LRB9211478DHcsam 1 (6) of subsection (c) of this Section, is exempt from length 2 limitations. 3 Local authorities and road district commissioners, with 4 respect to streets and highways under their jurisdiction, may 5 also by ordinance or resolution allow length limitations of 6 this subsection (e). 7 The length limitations described in this paragraph (e) 8 shall be exclusive of safety and energy conservation devices, 9 such as bumpers, refrigeration units or air compressors and 10 other devices, that the Department may interpret as necessary 11 for safe and efficient operation; except that no device 12 excluded under this paragraph shall have by its design or use 13 the capability to carry cargo. 14 (e-1) Combinations of vehicles not exceeding 65 feet 15 overall length are allowed access as follows: 16 (1) From any State designated highway onto any 17 county, township, or municipal highway for a distance of 18 5 highway miles for the purpose of loading and unloading, 19 provided: 20 (A) The vehicle does not exceed 73,280 pounds 21 in gross weight and 8 feet 6 inches in width. 22 (B) There is no sign prohibiting that access. 23 (C) The route is not being used as a 24 thoroughfare between State designated highways. 25 (2) From any State designated highway onto any 26 county or township highway for a distance of 5 highway 27 miles or onto any municipal highway for a distance of one 28 highway mile for the purpose of food, fuel, repairs, and 29 rest, provided: 30 (A) The vehicle does not exceed 73,280 pounds 31 in gross weight and 8 feet 6 inches in width. 32 (B) There is no sign prohibiting that access. 33 (C) The route is not being used as a 34 thoroughfare between State designated highways. -13- LRB9211478DHcsam 1 (e-2) Except as provided in subsection (e-3), 2 combinations of vehicles over 65 feet in length, with no 3 overall length limitation except as provided in subsections 4 (d) and (e) of this Section, are allowed access as follows: 5 (1) From a Class I highway onto any street or 6 highway for a distance of one highway mile for the 7 purpose of loading, unloading, food, fuel, repairs, and 8 rest, provided there is no sign prohibiting that access. 9 (2) From a Class I or Class II highway onto any 10 State highway or any locally designated highway for a 11 distance of 5 highway miles for the purpose of loading, 12 unloading, food, fuel, repairs, and rest. 13 (e-3) Combinations of vehicles over 65 feet in length 14 operated by household goods carriers, with no overall length 15 limitations except as provided in subsections (d) and (e) of 16 this Section, have unlimited access to points of loading and 17 unloading. 18 Section 5-35 of the Illinois Administrative Procedure Act 19 relating to procedures for rulemaking shall not apply to the 20 designation of highways under this paragraph (e). 21 (f) On Class III and other non-designated State 22 highways, the length limitations for vehicles in combination 23 are as follows: 24 (1) Truck tractor-semitrailer combinations, must 25 comply with either a maximum 55 feet overall wheel base 26 or a maximum 65 feet extreme overall dimension. 27 (2) Semitrailers, unladen or with load, may not 28 exceed 53 feet overall dimension. 29 (3) No truck tractor-semitrailer-trailer 30 combination may exceed 60 feet extreme overall dimension. 31 (4) The distance between the kingpin and the center 32 axle of a semitrailer longer than 48 feet, in combination 33 with a truck tractor, may not exceed 42 feet 6 inches. 34 (g) Length limitations in the preceding subsections of -14- LRB9211478DHcsam 1 this Section 15-107 do not apply to the following: 2 (1) Vehicles operated in the daytime, except on 3 Saturdays, Sundays, or legal holidays, when transporting 4 poles, pipe, machinery, or other objects of a structural 5 nature that cannot readily be dismembered, provided the 6 overall length of vehicle and load may not exceed 100 7 feet and no object exceeding 80 feet in length may be 8 transported unless a permit has been obtained as 9 authorized in Section 15-301. 10 (2) Vehicles and loads operated by a public utility 11 while en route to make emergency repairs to public 12 service facilities or properties, but during night 13 operation every vehicle and its load must be equipped 14 with a sufficient number of clearance lamps on both sides 15 and marker lamps upon the extreme ends of any projecting 16 load to clearly mark the dimensions of the load. 17 (3) A tow truck in combination with a disabled 18 vehicle or combination of disabled vehicles, provided the 19 towing vehicle meets the following conditions: 20 (A) It is specifically designed as a tow truck 21 having a gross vehicle weight rating of at least 22 18,000 pounds and equipped with air brakes, provided 23 that air brakes are required only if the towing 24 vehicle is towing a vehicle, semitrailer, or 25 tractor-trailer combination that is equipped with 26 air brakes. 27 (B) It is equipped with flashing, rotating, or 28 oscillating amber lights, visible for at least 500 29 feet in all directions. 30 (C) It is capable of utilizing the lighting 31 and braking systems of the disabled vehicle or 32 combination of vehicles. 33 (D) It does not engage in a tow exceeding 50 34 miles from the initial point of wreck or -15- LRB9211478DHcsam 1 disablement. 2 The Department may by rule or regulation prescribe 3 additional requirements regarding length limitations for a 4 tow truck towing another vehicle. 5 For the purpose of this subsection, gross vehicle weight 6 rating, or GVWR, shall mean the value specified by the 7 manufacturer as the loaded weight of the tow truck. Legal 8 holidays referred to in this Section shall be specified as 9 the day on which the following traditional holidays are 10 celebrated: 11 New Year's Day; 12 Memorial Day; 13 Independence Day; 14 Labor Day; 15 Thanksgiving Day; and 16 Christmas Day. 17 (h) The load upon any vehicle operated alone, or the 18 load upon the front vehicle of a combination of vehicles, 19 shall not extend more than 3 feet beyond the front wheels of 20 the vehicle or the front bumper of the vehicle if it is 21 equipped with a front bumper. The provisions of this 22 subsection (h) shall not apply to any vehicle or combination 23 of vehicles specifically designed for the collection and 24 transportation of waste, garbage, or recyclable materials 25 during the vehicle's operation in the course of collecting 26 garbage, waste, or recyclable materials if the vehicle is 27 traveling at a speed not in excess of 15 miles per hour 28 during the vehicle's operation and in the course of 29 collecting garbage, waste, or recyclable materials. However, 30 in no instance shall the load extend more than 7 feet beyond 31 the front wheels of the vehicle or the front bumper of the 32 vehicle if it is equipped with a front bumper. 33 (i) The load upon the front vehicle of a combination of 34 vehicles specifically designed to transport motor vehicles -16- LRB9211478DHcsam 1 shall not extend more than 3 feet beyond the foremost part of 2 the transporting vehicle and the load upon the rear 3 transporting vehicle shall not extend more than 4 feet beyond 4 the rear of the bed or body of the vehicle. This paragraph 5 shall only be applicable upon highways designated in 6 paragraphs (d) and (e) of this Section. 7 (j) Articulated vehicles comprised of 2 sections, 8 neither of which exceeds a length of 42 feet, designed for 9 the carrying of more than 10 persons, may be up to 60 feet in 10 length, not including energy absorbing bumpers, provided that 11 the vehicles are: 12 1. operated by or for any public body or motor 13 carrier authorized by law to provide public 14 transportation services; or 15 2. operated in local public transportation service 16 by any other person and the municipality in which the 17 service is to be provided approved the operation of the 18 vehicle. 19 (j-1) (Blank). 20 (k) Any person who is convicted of violating this 21 Section is subject to the penalty as provided in paragraph 22 (b) of Section 15-113. 23 (l) (Blank). 24 (Source: P.A. 92-417, eff. 1-1-02; 92-766, eff. 1-1-03.) 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.".
