 1        AN ACT in relation to vehicles.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Vehicle  Code  is amended by
 5    changing  Sections  3-412  and  3-414  and  adding   Sections
 6    3-405.3, 3-405.4, and 3-814.4 as follows:

 7        (625 ILCS 5/3-405.3 new)
 8        Sec. 3-405.3.  Application for fleet vehicles.
 9        (a)  An  owner  engaged  in  operating  a  fleet of motor
10    vehicles of the first division in this State or  a  fleet  of
11    second division vehicles operated intrastate may register and
12    license  the  fleet for operations in this State by filing an
13    application statement with the  Secretary  of  State,  signed
14    under  penalties  of  perjury, which shall be in the form and
15    contain the information required by the Secretary  of  State.
16    First division vehicles registered under this Section must be
17    registered  in accordance with the fees prescribed in Section
18    3-806 of this Code. Second division vehicles registered under
19    this Section must be registered in accordance with  the  fees
20    prescribed in Section 3-815 of this Code.
21        (b)  Participation  in the fleet registration plan may be
22    accomplished only by entering into  a  contractual  agreement
23    with  the  Secretary. The applicant must have electronic data
24    interchange capabilities. The Secretary shall in his  or  her
25    discretion determine other qualifications for fleet owners to
26    register  under  this paragraph. In making the determination,
27    the Secretary shall consider the size of the  fleet  and  the
28    past history of the registrant.

30        Sec  3-405.4.  Audits. In addition to audit authority set

 1    forth in Section 2-124 of this Code, the Secretary  of  State
 2    may  audit  the  registration  plates  and  the  inventory of
 3    credentials of any fleet owner  participating  in  the  fleet
 4    registration plan.

 6        Sec.   3-412.  Registration   plates   and   registration
 7    stickers to be furnished by the Secretary of State.
 8        (a)  The  Secretary  of  State upon registering a vehicle
 9    subject to annual registration  for  the  first  time   shall
10    issue   or  shall  cause  to  be  issued  to  the  owner  one
11    registration plate for a  motorcycle,  trailer,  semitrailer,
12    motorized  pedalcycle or truck-tractor, 2 registration plates
13    for other  motor  vehicles  and,  where  applicable,  current
14    registration   stickers  for  motor  vehicles  of  the  first
15    division.   The  provisions  of  this  Section  may  be  made
16    applicable to such vehicles of the second  division,  as  the
17    Secretary  of State may, from time to time, in his discretion
18    designate. On subsequent annual registrations during the term
19    of the registration plate as provided in Section 3-414.1, the
20    Secretary shall issue or  cause  to  be  issued  registration
21    stickers  as  evidence of current registration.  However, the
22    issuance  of  annual  registration   stickers   to   vehicles
23    registered  under  the provisions of Sections Section 3-402.1
24    and 3-405.3 of this Code may not be required if the Secretary
25    deems the issuance unnecessary.
26        (b)  Every registration plate shall have  displayed  upon
27    it  the registration number assigned to the vehicle for which
28    it  is  issued,  the  name  of  this  State,  which  may   be
29    abbreviated,  the  year number for which it was issued, which
30    may be abbreviated, the phrase "Land of Lincoln", (except  as
31    otherwise  provided  in  this  Code)  Sections  3-626, 3-629,
32    3-633, 3-634, 3-637, 3-638, and 3-642, and such other letters
33    or numbers as the Secretary  may  prescribe.    However,  for

 1    apportionment  plates  issued  to  vehicles  registered under
 2    Section  3-402.1  and  fleet  plates   issued   to   vehicles
 3    registered   under  Section  3-405.3,  the  phrase  "Land  of
 4    Lincoln" may be omitted to allow for the word  "apportioned",
 5    the word "fleet", or other similar language to be displayed.
 6    Registration plates issued to a vehicle registered as a fleet
 7    vehicle   may   display   a  designation  determined  by  the
 8    Secretary.
 9        The  Secretary  may  in  his  discretion  prescribe  that
10    letters be used  as  prefixes  only  on  registration  plates
11    issued to vehicles of the first division which are registered
12    under  this  Code and only as suffixes on registration plates
13    issued to other vehicles.  Every registration sticker  issued
14    as  evidence of current registration shall designate the year
15    number for which it is  issued  and  such  other  letters  or
16    numbers  as  the  Secretary  may  prescribe and shall be of a
17    contrasting  color   with   the   registration   plates   and
18    registration stickers of the previous year.
19        (c)  Each registration plate and the required letters and
20    numerals  thereon,  except  the year number for which issued,
21    shall be of sufficient size to be  plainly  readable  from  a
22    distance  of  100  feet  during daylight, and shall be coated
23    with reflectorizing material.  The dimensions  of  the  plate
24    issued  to  vehicles  of  the first division shall be 6 by 12
25    inches.
26        (d)  The  Secretary  of  State  shall  issue  for   every
27    passenger motor vehicle rented without a driver the same type
28    of  registration  plates  as  the type of plates issued for a
29    private passenger vehicle.
30        (e)  The  Secretary  of  State  shall  issue  for   every
31    passenger  car  used  as  a  taxicab  or  livery, distinctive
32    registration plates.
33        (f)  The  Secretary  of  State  shall  issue  for   every
34    motorcycle  distinctive  registration  plates  distinguishing

 1    between  motorcycles  having  150  or  more cubic centimeters
 2    piston displacement, or having less than 150 cubic centimeter
 3    piston displacement.
 4        (g)  Registration plates issued to vehicles for-hire  may
 5    display  a  designation  as  determined by the Secretary that
 6    such vehicles are for-hire.
 7        (h)  The Secretary of State shall issue for each electric
 8    vehicle   distinctive   registration   plates   which   shall
 9    distinguish  between  electric  vehicles  having  a   maximum
10    operating speed of 45 miles per hour or more and those having
11    a maximum operating speed of less than 45 miles per hour.
12        (i)  The  Secretary of State shall issue for every public
13    and private ambulance  registration  plates  identifying  the
14    vehicle  as an ambulance.  The Secretary shall forward to the
15    Department of Public Aid  registration  information  for  the
16    purpose  of  verification of claims filed with the Department
17    by ambulance  owners  for  payment  for  services  to  public
18    assistance recipients.
19        (j)  The  Secretary of State shall issue for every public
20    and  private  medical  carrier  or  rescue   vehicle   livery
21    registration  plates  displaying  numbers  within  ranges  of
22    numbers reserved respectively for medical carriers and rescue
23    vehicles.   The  Secretary shall forward to the Department of
24    Public  Aid  registration  information  for  the  purpose  of
25    verification of claims filed with the Department by owners of
26    medical carriers or rescue vehicles for payment for  services
27    to public assistance recipients.

33        Sec. 3-414.  Expiration of registration.

 1        (a)  Every vehicle registration under  this  Chapter  and
 2    every   registration   card   and   registration   plate   or
 3    registration  sticker  issued hereunder to a vehicle shall be
 4    for the periods specified in this Chapter and shall expire at
 5    midnight on the day and date specified  in  this  Section  as
 6    follows:
 7             1.  When   registered   on  a  calendar  year  basis
 8        commencing January 1, expiration shall be on the 31st day
 9        of December or at such other date as may be  selected  in
10        the  discretion  of  the  Secretary  of  State;  however,
11        registrations  of  apportionable  vehicles,  motorcycles,
12        motor driven cycles and pedalcycles shall commence on the
13        first  day  of  April  and shall expire March 31st of the
14        following calendar year;
15             2.  When registered  on  a  2  calendar  year  basis
16        commencing January 1 of an even-numbered year, expiration
17        shall  be  on  the  31st  day  of December of the ensuing
18        odd-numbered year, or at such other later date as may  be
19        selected  in the discretion of the Secretary of State not
20        beyond March 1 next;
21             3.  When  registered  on   a   fiscal   year   basis
22        commencing July 1, expiration shall be on the 30th day of
23        June  or  at  such other later date as may be selected in
24        the discretion of  the  Secretary  of  State  not  beyond
25        September 1 next;
26             4.  When   registered  on  a  2  fiscal  year  basis
27        commencing July 1 of an  even-numbered  year,  expiration
28        shall  be  on  the  30th  day  of  June  of  the  ensuing
29        even-numbered year, or at such other later date as may be
30        selected  in the discretion of the Secretary of State not
31        beyond September 1 next;
32             5.  When  registered  on  a  4  fiscal  year   basis
33        commencing  July  1  of an even-numbered year, expiration
34        shall be on the 30th day of June of  the  second  ensuing

 1        even-numbered year, or at such other later date as may be
 2        selected  in the discretion of the Secretary of State not
 3        beyond September 1 next;
 4        (b)  Vehicle  registrations  of  vehicles  of  the  first
 5    division shall be for a calendar  year  or  2  calendar  year
 6    basis as provided for in this Chapter.
 7        Vehicle  registrations  of vehicles under Sections 3-807,
 8    3-808 and 3-809 shall be on an indefinite term basis or  a  2
 9    calendar year basis as provided for in this Chapter.
10        Vehicle registrations for vehicles of the second division
11    shall  be  for  a fiscal year, 2 fiscal year or calendar year
12    basis as provided for in this Chapter.
13        Motor  vehicles  registered  under  the   provisions   of
14    Sections   Section   3-402.1  and  3-405.3  shall  be  issued
15    multi-year registration plates with a new  registration  card
16    issued   annually  upon  payment  of  the  appropriate  fees.
17    Apportionable   trailers   and   apportionable   semitrailers
18    registered under the provisions of Section 3-402.1  shall  be
19    issued  multi-year registration plates and cards that will be
20    subject to revocation for failure to pay annual fees required
21    by Section 3-814.1.  The Secretary shall determine when these
22    vehicles shall be issued new registration plates.
23        (c)  Every vehicle  registration  specified  in   Section
24    3-810  and  every registration card and registration plate or
25    registration sticker issued thereunder shall  expire  on  the
26    31st  day  of  December of each year or at such other date as
27    may be selected in the discretion of the Secretary of State.
28        (d)  Every vehicle registration  for  a  vehicle  of  the
29    second   division  weighing  over  8,000  pounds,  except  as
30    provided  in  paragraph  (g)  of  this  Section,  and   every
31    registration  card  and  registration  plate  or registration
32    sticker, where applicable, issued hereunder to such  vehicles
33    shall  be  issued for a fiscal year commencing on July 1st of
34    each registration year. However, the Secretary of State  may,

 1    pursuant  to  an  agreement  or  arrangement  or  declaration
 2    providing for apportionment of a fleet of vehicles with other
 3    jurisdictions,  provide  for  registration  of  such vehicles
 4    under apportionment or for all of the vehicles registered  in
 5    Illinois  by  an applicant who registers some of his vehicles
 6    under apportionment on a calendar year basis instead, and the
 7    fees or taxes to be paid on a calendar year  basis  shall  be
 8    identical  to  those  specified in this Act for a fiscal year
 9    registration.  Provision for installment payment may also  be
10    made.
11        (e)  Semitrailer registrations under apportionment may be
12    on   a   calendar   year  under  a  reciprocal  agreement  or
13    arrangement and all other semitrailer registrations shall  be
14    on  fiscal  year  or  2 fiscal year or 4 fiscal year basis as
15    provided for in this Chapter.
16        (f)  The  Secretary   of   State   may   convert   annual
17    registration  plates  or  2-year registration plates, whether
18    registered on a  calendar  year  or  fiscal  year  basis,  to
19    multi-year   plates.    The   determination  of  which  plate
20    categories and when to convert to multi-year plates is solely
21    within the discretion of the Secretary of State.
22        (g)  After   January   1,   1975,   each    registration,
23    registration  card  and  registration  plate  or registration
24    sticker, where applicable, issued for a recreational  vehicle
25    or  recreational  or camping trailer, except a house trailer,
26    used exclusively by the owner for recreational purposes,  and
27    not  used  commercially  nor as a truck or bus, nor for hire,
28    shall be on a calendar year basis; except that the  Secretary
29    of  State  shall provide for registration and the issuance of
30    registration cards and plates or registration stickers, where
31    applicable, for one 6-month period in order to accomplish  an
32    orderly  transition  from  a  fiscal  year to a calendar year
33    basis.  Fees and taxes due under this Act for a  registration
34    year   shall   be  appropriately  reduced  for  such  6-month

 1    transitional registration period.
 2        (h)  The Secretary of State may, in order  to  accomplish
 3    an  orderly  transition for vehicles registered under Section
 4    3-402.1 of this Code from a calendar year registration  to  a
 5    March  31st  expiration,  require  applicants to pay fees and
 6    taxes due under this Code on a 15 month  registration  basis.
 7    However,  if in the discretion of the Secretary of State this
 8    creates an undue hardship on any applicant the Secretary  may
 9    allow the applicant to pay 3 month fees and taxes at the time
10    of registration and the additional 12 month fees and taxes to
11    be  payable  no  later  than  March 31 of the year after this
12    amendatory Act of 1991 takes effect.
13        (i)  The Secretary of State may stagger registrations, of
14    vehicles for which multi-year plates are issued  pursuant  to
15    Section  3-414.1,  as  necessary  for  the convenience of the
16    public and  the  efficiency  of  his  Office.   In  order  to
17    appropriately and effectively accomplish any such staggering,
18    the  Secretary  of  State  is  authorized to prorate required
19    registration fees, but in no event for a period  longer  than
20    15 months, at a monthly rate for a 12 month registration fee.

22        (625 ILCS 5/3-814.4 new)
23        Sec.   3-814.4   Registration   of  fleet  vehicles.  The
24    Secretary may issue  fleet  vehicle  registration  plates  to
25    owners  of  vehicle  fleets  registered  in  accordance  with
26    Section  3-405.3  of  this  Code  in  bulk  before plates are
27    assigned to specific vehicles. A registration plate  may  not
28    be  displayed on a vehicle, however, until the plate has been
29    activated on the  Secretary's    registration  file  and  the
30    proper fee has been forwarded to the Secretary.

31        Section  99.  Effective date.  This Act takes effect July
32    1, 2003.
