92_HB4878 LRB9212090ACsb 1 AN ACT concerning roofing. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Roofing Industry Licensing Act 5 is amended by changing Section 2 as follows: 6 (225 ILCS 335/2) (from Ch. 111, par. 7502) 7 (Section scheduled to be repealed on January 1, 2006) 8 Sec. 2. Definitions. As used in this Act, unless the 9 context otherwise requires: 10 (a) "Licensure" means the act of obtaining or holding a 11 license issued by the Department as provided in this Act. 12 (b) "Department" means the Department of Professional 13 Regulation. 14 (c) "Director" means the Director of Professional 15 Regulation. 16 (d) "Person" means any individual, partnership, 17 corporation, business trust, limited liability company, or 18 other legal entity. 19 (e) "Roofing contractor" is one whose services are 20 unlimited in the roofing trade and who has the experience, 21 knowledge and skill to construct, reconstruct, alter, 22 maintain and repair roofs and use materials and items used in 23 the construction, reconstruction, alteration, maintenance and 24 repair of all kinds of roofing and waterproofing, all in a 25suchmanner to comply with all plans, specifications, codes, 26 laws, and regulations applicable thereto, but does not 27 include such contractor's employees to the extent the 28 requirements of Section 3 of this Act apply and extend to 29 such employees. 30 (f) "Board" means the Roofing Advisory Board. 31 (g) "Qualifying party" means the individual filing as a -2- LRB9212090ACsb 1 sole proprietor, partner of a partnership, officer of a 2 corporation, trustee of a business trust, or party of another 3 legal entity, who is legally qualified to act for the 4 business organization in all matters connected with its 5 roofing contracting business, has the authority to supervise 6 roofing installation operations, and is actively engaged in 7 day to day activities of the business organization. 8 "Qualifying party" does not apply to a seller of roofing 9 materials or services when the construction, reconstruction, 10 alteration, maintenance, or repair of roofing or 11 waterproofing is to be performed by a person other than the 12 seller or the seller's employees. 13 (h) "Limited roofing license" means a license made 14 available to contractors whose roofing business is limited to 15 residential roofing, including residential properties 16 consisting of 8 units or less. 17 (i) "Unlimited roofing license" means a license made 18 available to contractors whose roofing business is unlimited 19 in nature and includes roofing on residential, commercial, 20 and industrial properties. 21 (Source: P.A. 90-55, eff. 1-1-98; 91-950, eff. 2-9-01.)
