92_HB4720enr HB4720 Enrolled LRB9212051WHcs 1 AN ACT in relation to business transactions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Equipment Fair Dealership Law is 5 amended by adding Section 4.5 as follows: 6 (815 ILCS 715/4.5 new) 7 Sec. 4.5. Warranty work. Retailers who do warranty 8 repair work for a consumer under the provisions of a 9 manufacturer's express warranty shall be reimbursed by the 10 manufacturer for warranty work at an hourly rate that is the 11 same as or greater than the hourly labor rate that the 12 retailer charges consumers for non-warranty repair work. 13 The provisions of this Section shall not apply to a 14 supplier or dealer where a written dealer agreement provides 15 for compensation to a dealer for warranty labor costs either 16 as part of the pricing of the equipment to the dealer or in 17 the form of a lump sum payment, provided the payment is not 18 less than 5% of the suggested retail price of the equipment.
