 1        AN ACT in relation to firearm safety.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Attorney General Act is amended by  adding
 5    Section 4e as follows:

 6        (15 ILCS 205/4f new)
 7        Sec. 4e.  Firearm and ammunition safety.
 8        (a)  The Attorney General may by rule regulate the safety
 9    of  firearms and firearm ammunition sold or possessed in this
10    State.
11        (b)  The Attorney General may:
12             (1)  prohibit the sale or transfer  of  firearms  or
13        firearm  ammunition  that  he  or  she  determines  to be
14        defective or unsafe;
15             (2)  require  the  recall  of  firearms  or  firearm
16        ammunition sold in this State that he or  she  determines
17        to be defective or unsafe;
18             (3)  require  or  perform  testing  of  firearms  or
19        firearm  ammunition  to  determine  if  the  firearms  or
20        firearm ammunition are defective or unsafe;
21             (4)  establish  rules  concerning  the safe storage,
22        handling,  and  transportation  of  firearms,  which  may
23        include, without limitation, the use of trigger locks and
24        appropriate standards for casing and packaging; and
25             (5)  establish standards for ammunition sold or used
26        in this State, which  may  include,  without  limitation,
27        restrictions  on  ammunition  that is inappropriate for a
28        particular use.
29        (c)  The  Attorney  General  is  immune  from  civil   or
30    criminal  liability for injuries or property damage resulting
31    from the rules adopted under this Section or from the failure

 1    to adopt rules under this Section.
 2        (d)  The rules adopted by the Attorney General under this
 3    Section may provide for the imposition of civil penalties for
 4    violations.  The Attorney General may seek an order enforcing
 5    the civil penalty in the circuit court of Sangamon County  or
 6    the county in which the violation occurred.
 7        (e)  The  Attorney  General  may  seek  an  order  in the
 8    circuit court of Sangamon County or any county  in  which  an
 9    actual  or  threatened  violation  of the rules adopted under
10    this Section did or is likely to occur, compelling compliance
11    with  the  rules  and  enjoining  any  actual  or  threatened
12    violation.
13        (f)  This  Section  and  the  rules  adopted  under  this
14    Section do not apply to  the  use  of  firearms  and  firearm
15    ammunition   by  members  or  employees  of  law  enforcement
16    agencies, the Armed Forces  of  the  United  States,  or  the
17    Illinois National Guard in the course of their duties.
18        (g)  For  the  purposes  of  this  Section, "firearm" and
19    "firearm ammunition" have the meanings ascribed  to  them  in
20    Section 1.1 of the Firearm Owners Identification Card Act.
