92_HB4188eng HB4188 Engrossed LRB9215091BDdvA 1 AN ACT concerning local government. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Counties Code is amended by adding 5 Section 5-1126 as follows: 6 (55 ILCS 5/5-1126 new) 7 Sec. 5-1126. A county board may license or regulate any 8 business operating as a public accommodation that is located 9 in an unincorporated area of the county, that permits the 10 consumption of alcoholic liquor on the business premises, and 11 that is not licensed under the Liquor Control Act of 1934. 12 For purposes of this Section, "public accommodation" means a 13 refreshment, entertainment, or recreation facility of any 14 kind, whether licensed or not, whose goods, services, 15 facilities, privileges, or advantages are extended, offered, 16 sold, or otherwise made available to the public. 17 Section 10. The Illinois Municipal Code is amended by 18 adding Section 11-42-10.1 as follows: 19 (65 ILCS 5/11-42-10.1 new) 20 Sec. 11-42-10.1. The corporate authorities of each 21 municipality may license or regulate businesses operating as 22 a public accommodation that permit the consumption of 23 alcoholic liquor on the business premises and that are not 24 licensed under the Liquor Control Act of 1934. For purposes 25 of this Section, "public accommodation" means a refreshment, 26 entertainment, or recreation facility of any kind, whether 27 licensed or not, whose goods, services, facilities, 28 privileges, or advantages are extended, offered, sold, or 29 otherwise made available to the public.
