92_HB4150 LRB9214869ACmg 1 AN ACT concerning professional regulation. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Detection of Deception Examiners Act is 5 amended by changing Section 3 as follows: 6 (225 ILCS 430/3) (from Ch. 111, par. 2403) 7 (Section scheduled to be repealed on January 1, 2012) 8 Sec. 3. Recording instruments; test results. 9 (a) Every examiner shall use an instrument which records 10 permanently and simultaneously the subject's cardiovascular, 11 respiratory and galvanic skin response patterns as minimum 12 standards and shall base his evaluation upon changes in such 13 patterns, except as provided for in subsection (b) of this 14 Section. Such an instrument may record additional 15 physiological patterns pertinent to the detection of 16 deception. The examiner may also consider changes in such 17 additional patterns in making his evaluations. 18 (b) An examiner who is a qualified operator of a 19 Computer Voice Stress Analyzer that records voice stress 20 factors pertinent to the detection of deception as an 21 investigative tool may use a Computer Voice Stress Analyzer 22 in place of the instrument provided for in subsection (a) of 23 this Section. 24 A qualified operator, for purposes of this subsection, is 25 a person who has completed a minimum of 59 hours of training 26 in a certified psychological stress evaluation testing course 27 that is approved by the Department. 28 (c) An examiner shall, upon written request of a person 29 examined, make known the results of asuchtest to the person 30 examined within 5 days of receipt of the written request. 31 (Source: P.A. 82-200.)
