92_HB4134 LRB9211870WHcs 1 AN ACT concerning civil immunity. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Good Samaritan Act is amended by adding 5 Section 12 as follows: 6 (745 ILCS 49/77 new) 7 Sec. 77. Architects, professional engineers, and 8 structural engineers; exemption from civil liability for 9 emergency services. 10 (a) Definitions. As used in this Section: 11 "Architect" has the meaning ascribed to that term in 12 Section 5 of the Illinois Architecture Practice Act of 1989. 13 "Professional engineer" has the meaning ascribed to that 14 term in Section 4 of the Professional Engineering Practice 15 Act of 1989. 16 "Structural engineer" has the meaning ascribed to that 17 term in Section 4 of the Structural Engineering Practice Act 18 of 1989. 19 (b) An architect, professional engineer, or structural 20 engineer who voluntarily, without compensation (other than 21 expense reimbursement), provides architectural, structural, 22 electrical, mechanical, or other design professional services 23 related to homeland security or a declared national, State, 24 or local emergency or disaster caused by an earthquake, 25 hurricane, tornado, fire, explosion, collapse, or other 26 similar disaster or catastrophic event is not liable for any 27 personal injury, wrongful death, property damage, or other 28 loss of any nature related to the acts, errors, or omissions 29 of the architect, professional engineer, or structural 30 engineer in the performance of any architectural or 31 engineering services relating to any structure, building, -2- LRB9211870WHcs 1 facility, project utility, equipment, machine, process, 2 piping, or other system, either publicly or privately owned, 3 except for willful or wanton misconduct on the part of the 4 person providing the services.
