92_HB4059 LRB9210189ACcdA 1 AN ACT concerning the regulation of professions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Plumbing License Law is amended 5 by changing Section 2.5 as follows: 6 (225 ILCS 320/2.5) 7 (Section scheduled to be repealed on January 1, 2003) 8 Sec. 2.5. Irrigation contractors; lawn sprinkler 9 systems. 10 (a) Every irrigation contractor doing business in this 11 State shall annually register with the Department. Every 12 irrigation contractor shall provide to the Department his or 13 her business name and address, telephone number, name of 14 principal, and FEIN number. Every irrigation contractor doing 15 business in this State shall also register with the 16 Department each and every employee who installs or supervises 17 the installation of lawn sprinkler systems. The registration 18 shall include the employee's name, home address, and 19 telephone number. The Department may provide by rule for the 20 administration of registrations under this subsection. The 21 annual registration fee shall be set by the Department 22 pursuant to Section 30 of this Act. 23 (b) A licensed plumber or licensed apprentice plumber 24 may install a lawn sprinkler system connected to any water 25 source without registration under this Section. 26 (c) A licensed plumber shall inspect every sprinkler 27 system installed by an irrigation contractor to ensure the 28 provisions of this Section have been met and that the system 29 works mechanically. A licensed plumber shall make the 30 physical connection between a lawn sprinkler system and the 31 backflow prevention device. -2- LRB9210189ACcdA 1 Upon the installation of every lawn sprinkler system in 2 this State from the effective date of this amendatory Act of 3 the 91st General Assembly forward, a licensed plumber shall 4 affix to the backflow prevention device a tag certifying that 5 the installation of that system has been completed in 6 compliance with the minimum code of plumbing standards 7 promulgated under this Act. The Department shall provide by 8 rule for the registration of every lawn sprinkler system 9 installed after the effective date of this amendatory Act of 10 the 91st General Assembly, including the means by which the 11 Department shall be able to identify by registration number 12 the identity of the responsible irrigation contractor and by 13 license number the identity of the responsible licensed 14 plumber. No lawn sprinkler system installed after the 15 effective date of this amendatory Act of the 91st General 16 Assembly may be operated without the certification tag 17 required under this Section. 18 The registered irrigation contractor and the licensed 19 plumber whose identifying information is contained on the 20 certification tag shall both be subject to the penalty 21 provisions of this Act for violations for improper 22 installation of a lawn sprinkler system installed after the 23 effective date of this amendatory Act of the 91st General 24 Assembly. 25 (d) An irrigation contractor that has registered with 26 the Department 7 or fewer persons who are authorized to 27 install or supervise the installation of lawn sprinkler 28 systems shall either employ or contract with at least one 29 licensed plumber who shall install or be responsible for the 30 installation of every lawn sprinkler system installed after 31 the effective date of this amendatory Act of the 91st General 32 Assembly. The licensed plumber shall inspect the risers and 33 sprinkler heads before backfilling. 34 An irrigation contractor that has registered with the -3- LRB9210189ACcdA 1 Department 8 to 12 persons who are authorized to install or 2 supervise the installation of lawn sprinkler systems shall 3 either employ or contract with at least 2 licensed plumbers 4 who shall install or be responsible for the installation of 5 every lawn sprinkler system installed after the effective 6 date of this amendatory Act of the 91st General Assembly. A 7 licensed plumber shall inspect the risers and sprinkler heads 8 before backfilling. 9 An irrigation contractor that has registered with the 10 Department 13 to 20 persons who are authorized to install or 11 supervise the installation of lawn sprinkler systems shall 12 either employ or contract with at least 3 licensed plumbers 13 who shall install or be responsible for the installation of 14 every lawn sprinkler system installed after the effective 15 date of this amendatory Act of the 91st General Assembly. A 16 licensed plumber shall inspect the risers and sprinkler heads 17 before backfilling. 18 An irrigation contractor that has registered with the 19 Department 21 to 28 persons who are authorized to install or 20 supervise the installation of lawn sprinkler systems shall 21 either employ or contract with at least 4 licensed plumbers 22 who shall install or be responsible for the installation of 23 every lawn sprinkler system installed after the effective 24 date of this amendatory Act of the 91st General Assembly. A 25 licensed plumber shall inspect the risers and sprinkler heads 26 before backfilling. 27 An irrigation contractor that has registered with the 28 Department 29 to 35 persons who are authorized to install or 29 supervise the installation of lawn sprinkler systems shall 30 either employ or contract with at least 5 licensed plumbers 31 who shall install or be responsible for the installation of 32 every lawn sprinkler system installed after the effective 33 date of this amendatory Act of the 91st General Assembly. A 34 licensed plumber shall inspect the risers and sprinkler heads -4- LRB9210189ACcdA 1 before backfilling. 2 An irrigation contractor that has registered with the 3 Department 36 or more persons who are authorized to install 4 or supervise the installation of lawn sprinkler systems shall 5 either employ or contract with at least 6 licensed plumbers 6 who shall install or be responsible for the installation of 7 every lawn sprinkler system installed after the effective 8 date of this amendatory Act of the 91st General Assembly. A 9 licensed plumber shall inspect the risers and sprinkler heads 10 before backfilling. 11 The Department may provide by rule for the temporary 12 waiver process for registered irrigation contractors who are 13 unable to comply with the requirements of this subsection. 14 When a temporary waiver is granted, it shall not be for a 15 duration of more than 3 consecutive months. Upon the 16 expiration of a temporary waiver issued by the Department, 17 the registered irrigation contractor shall demonstrate that 18 justifiable reasons exist why he or she is still unable to 19 comply with the requirements of this subsection, despite good 20 faith efforts to comply with the requirements. In no case 21 shall a temporary waiver be granted for an irrigation 22 contractor for more than a total of 6 months in a two-year 23 period. In no case shall an irrigation contractor be relieved 24 of the requirement that a licensed plumber shall inspect 25 every sprinkler system installed by an irrigation contractor 26 to ensure the provisions of this Section have been met and 27 that the system works mechanically and make the physical 28 connection between a sprinkler system and the backflow 29 prevention device. 30 (e) No person shall attach to a lawn sprinkler system 31 any fixture intended to supply water for human consumption. 32 No person shall attach to a lawn sprinkler system any 33 fixture other than the backflow prevention device, sprinkler 34 heads, valves, and other parts integral to the operation of -5- LRB9210189ACcdA 1 the system, unless the fixture is clearly marked as being for 2 non-potable uses only. 3 (f) This Section is repealed January 1, 20132003, and 4 all registrations under this Section terminate on that date. 5 (Source: P.A. 91-678, eff. 1-26-00.) 6 Section 99. Effective date. This Act takes effect upon 7 becoming law.
