1 AN ACT concerning telephone solicitations.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Telephone Solicitations Act is amended by
5 adding Section 16 as follows:
6 (815 ILCS 413/16 new)
7 Sec. 16. Telephone solicitation; listing.
8 (a) The Illinois Commerce Commission shall establish,
9 maintain, and publish a quarterly listing of telephone
10 numbers of Illinois consumers who request not to be solicited
11 by telephone.
12 (b) The telephone number of a consumer shall be placed
13 on the listing if the consumer requests to be added to the
14 listing according to a procedure approved by the Commission.
15 (c) The listing shall be updated upon receipt of a
16 request from a consumer.
17 (d) The Commission shall provided a copy of the listing
18 to a telephone solicitor upon request.
19 (e) The Commission shall establish a fee to be paid by a
20 telephone solicitor for obtaining a copy of the listing. The
21 fee established under this subsection may not exceed the
22 amount necessary to cover the cost of providing the listing
23 to telephone solicitors.
24 (f) The Commission may contract with an agent to perform
25 its duties under this Section if (i) the agent has
26 demonstrated experience in maintaining a national no sales
27 solicitation calls listing and (ii) the contract requires the
28 vendor to provide the listing in a printed hard copy format
29 and any other format offered at a cost that does not exceed
30 the production cost of the format offered. If the Commission
31 enters into a contract under this subsection, the Commission

1 must retain the ultimate authority for (i) approval of the
2 procedures for establishment, maintenance, and publication of
3 the listing and (ii) establishing the fees required by this
4 Section.
5 (g) The Commission shall notify Illinois residents of
6 the rights and duties created by this Section.
7 (h) The Commission may adopt any rules necessary to
8 implement this Section.
