92_HB3636 LRB9209387LDprA 1 AN ACT concerning higher education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The University of Illinois Act is amended by 5 adding Section 7e-5 as follows: 6 (110 ILCS 305/7e-5 new) 7 Sec. 7e-5. In-state tuition charge. 8 (a) For tuition purposes, the Board of Trustees must 9 classify an individual who is not a citizen or permanent 10 resident of the United States as an Illinois resident, until 11 the individual establishes a residence outside of this State, 12 if all of the following conditions are met: 13 (1) The individual resided with his or her parent 14 or guardian while attending a public or private high 15 school in this State. 16 (2) The individual graduated from a public or 17 private high school or received the equivalent of a high 18 school diploma in this State. 19 (3) The individual resided in this State for at 20 least 3 years as of the date the individual graduated 21 from high school or received the equivalent of a high 22 school diploma. 23 (4) The individual registers as an entering student 24 in the University not earlier than the 2002 fall 25 semester. 26 (5) The individual provides to the University an 27 affidavit stating that the individual will file an 28 application to become a permanent resident of the United 29 States at the earliest opportunity the individual is 30 eligible to do so. 31 (b) An alien who is living in the United States under a -2- LRB9209387LDprA 1 visa permitting permanent residence or who has applied to or 2 has a petition pending with the Immigration and 3 Naturalization Service to attain lawful status under federal 4 immigration law must be given the same privilege of 5 qualifying for resident status for tuition and fee purposes 6 as a citizen of the United States. 7 (c) A foreign student who is a resident of Mexico and 8 who demonstrates a financial need, after the financial 9 resources of the foreign student and the student's family are 10 considered, is entitled to pay tuition at the rate provided 11 for Illinois residents. The Board of Trustees shall adopt 12 rules governing the determination of financial need of 13 students under this subsection (c). 14 (d) An individual who is 18 years of age or under or is 15 a dependent and who, along with one of the individual's 16 parents, was formerly a resident of this State is entitled to 17 pay tuition at the rate provided for Illinois residents if 18 all of the following conditions are met: 19 (1) The individual and the parent with whom the 20 individual primarily resides change their legal residence 21 from this State to another state. 22 (2) The other parent, with whom the individual does 23 not primarily reside, continues to reside in this State 24 and is not delinquent on the payment of any child 25 support. 26 (e) This Section applies only to tuition for a term or 27 semester that begins on or after the effective date of this 28 amendatory Act of the 92nd General Assembly. 29 Section 10. The Southern Illinois University Management 30 Act is amended by adding Section 8d-5 as follows: 31 (110 ILCS 520/8d-5 new) 32 Sec. 8d-5. The Chicago State University Law is amended 20 by adding Section 5-88 as follows: 21 (110 ILCS 660/5-88 new) 22 Sec. 5-88. The Eastern Illinois University Law is 10 amended by adding Section 10-88 as follows: 11 (110 ILCS 665/10-88 new) 12 Sec. 10-88. The Governors State University Law is -8- LRB9209387LDprA 1 amended by adding Section 15-88 as follows: 2 (110 ILCS 670/15-88 new) 3 Sec. 15-88. The Illinois State University Law is amended 24 by adding Section 20-88 as follows: 25 (110 ILCS 675/20-88 new) 26 Sec. 20-88. The Northeastern Illinois University Law is 14 amended by adding Section 25-88 as follows: 15 (110 ILCS 680/25-88 new) 16 Sec. 25-88. The Northern Illinois University Law is 4 amended by adding Section 30-88 as follows: 5 (110 ILCS 685/30-88 new) 6 Sec. 30-88. The Western Illinois University Law is 28 amended by adding Section 35-88 as follows: 29 (110 ILCS 690/35-88 new) 30 Sec. 35-88. Effective date. This Act takes effect upon 18 becoming law.
