92_HB3627 LRB9209029DHsb 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Finance Act is amended by adding 5 Section 5.545 as follows: 6 (30 ILCS 105/5.545 new) 7 Sec. 5.546. Phi Kappa Psi Fraternity Scholarship Fund. 8 Section 10. The Illinois Vehicle Code is amended by 9 changing Section 3-412 and adding Section 3-648 as follows: 10 (625 ILCS 5/3-412) (from Ch. 95 1/2, par. 3-412) 11 Sec. 3-412. Registration plates and registration 12 stickers to be furnished by the Secretary of State. 13 (a) The Secretary of State upon registering a vehicle 14 subject to annual registration for the first time shall 15 issue or shall cause to be issued to the owner one 16 registration plate for a motorcycle, trailer, semitrailer, 17 motorized pedalcycle or truck-tractor, 2 registration plates 18 for other motor vehicles and, where applicable, current 19 registration stickers for motor vehicles of the first 20 division. The provisions of this Section may be made 21 applicable to such vehicles of the second division, as the 22 Secretary of State may, from time to time, in his discretion 23 designate. On subsequent annual registrations during the term 24 of the registration plate as provided in Section 3-414.1, the 25 Secretary shall issue or cause to be issued registration 26 stickers as evidence of current registration. However, the 27 issuance of annual registration stickers to vehicles 28 registered under the provisions of Section 3-402.1 of this 29 Code may not be required if the Secretary deems the issuance -2- LRB9209029DHsb 1 unnecessary. 2 (b) Every registration plate shall have displayed upon 3 it the registration number assigned to the vehicle for which 4 it is issued, the name of this State, which may be 5 abbreviated, the year number for which it was issued, which 6 may be abbreviated, the phrase "Land of Lincoln", except as 7 provided in Sections 3-626, 3-628, 3-629, 3-633, 3-634, 8 3-637, 3-638,and3-642, 3-645, 3-647, and 3-648, and such 9 other letters or numbers as the Secretary may prescribe. 10 However, for apportionment plates issued to vehicles 11 registered under Section 3-402.1, the phrase "Land of 12 Lincoln" may be omitted to allow for the word "apportioned" 13 to be displayed. The Secretary may in his discretion 14 prescribe that letters be used as prefixes only on 15 registration plates issued to vehicles of the first division 16 which are registered under this Code and only as suffixes on 17 registration plates issued to other vehicles. Every 18 registration sticker issued as evidence of current 19 registration shall designate the year number for which it is 20 issued and such other letters or numbers as the Secretary may 21 prescribe and shall be of a contrasting color with the 22 registration plates and registration stickers of the previous 23 year. 24 (c) Each registration plate and the required letters and 25 numerals thereon, except the year number for which issued, 26 shall be of sufficient size to be plainly readable from a 27 distance of 100 feet during daylight, and shall be coated 28 with reflectorizing material. The dimensions of the plate 29 issued to vehicles of the first division shall be 6 by 12 30 inches. 31 (d) The Secretary of State shall issue for every 32 passenger motor vehicle rented without a driver the same type 33 of registration plates as the type of plates issued for a 34 private passenger vehicle. -3- LRB9209029DHsb 1 (e) The Secretary of State shall issue for every 2 passenger car used as a taxicab or livery, distinctive 3 registration plates. 4 (f) The Secretary of State shall issue for every 5 motorcycle distinctive registration plates distinguishing 6 between motorcycles having 150 or more cubic centimeters 7 piston displacement, or having less than 150 cubic centimeter 8 piston displacement. 9 (g) Registration plates issued to vehicles for-hire may 10 display a designation as determined by the Secretary that 11 such vehicles are for-hire. 12 (h) The Secretary of State shall issue for each electric 13 vehicle distinctive registration plates which shall 14 distinguish between electric vehicles having a maximum 15 operating speed of 45 miles per hour or more and those having 16 a maximum operating speed of less than 45 miles per hour. 17 (i) The Secretary of State shall issue for every public 18 and private ambulance registration plates identifying the 19 vehicle as an ambulance. The Secretary shall forward to the 20 Department of Public Aid registration information for the 21 purpose of verification of claims filed with the Department 22 by ambulance owners for payment for services to public 23 assistance recipients. 24 (j) The Secretary of State shall issue for every public 25 and private medical carrier or rescue vehicle livery 26 registration plates displaying numbers within ranges of 27 numbers reserved respectively for medical carriers and rescue 28 vehicles. The Secretary shall forward to the Department of 29 Public Aid registration information for the purpose of 30 verification of claims filed with the Department by owners of 31 medical carriers or rescue vehicles for payment for services 32 to public assistance recipients. 33 (Source: P.A. 89-424, eff. 6-1-96; 89-564, eff. 7-1-97; 34 89-612, eff. 8-9-96; 89-621, eff. 1-1-97; 89-639, eff. -4- LRB9209029DHsb 1 1-1-97; 90-14, eff. 7-1-97; 90-533, eff. 11-14-97; 90-655, 2 eff. 7-30-98.) 3 (625 ILCS 5/3-648 new) 4 Sec. 3-648. Phi Kappa Psi Fraternity license plates. 5 (a) In addition to any other special license plate, the 6 Secretary, upon receipt of all applicable fees and 7 applications made in the form prescribed by the Secretary of 8 State, may issue special registration plates designated as 9 Phi Kappa Psi Fraternity license plates to residents of 10 Illinois who meet eligibility requirements prescribed by the 11 Secretary of State. The special plate issued under this 12 Section shall be affixed only to passenger vehicles of the 13 first division, motor vehicles of the second division 14 weighing not more than 8,000 pounds, and recreational 15 vehicles as defined by Section 1-169 of this Code. Plates 16 issued under this Section shall expire according to the 17 staggered multi-year procedure established by Section 3-414.1 18 of this Code. 19 (b) The design, color, and format of the plates shall be 20 wholly within the discretion of the Secretary of State, 21 except that the Phi Kappa Psi Fraternity Insignia shall 22 appear on the plates. The Secretary may, in his or her 23 discretion, allow the plates to be issued as vanity or 24 personalized plates in accordance with Section 3-405.1 of 25 this Code. The plates are not required to designate "Land Of 26 Lincoln", as prescribed in subsection (b) of Section 3-412 of 27 this Code. The Secretary shall prescribe the eligibility 28 requirements and, in his or her discretion, shall approve and 29 prescribe stickers or decals as provided under Section 3-412. 30 (c) An applicant shall be charged a $20 fee for original 31 issuance in addition to the applicable registration fee. Of 32 this additional fee, $15 shall be deposited into the 33 Secretary of State Special License Plate Fund and $5 shall be -5- LRB9209029DHsb 1 deposited into the Phi Kappa Psi Fraternity Scholarship Fund. 2 For each registration renewal period, a $20 fee, in addition 3 to the appropriate registration fee, shall be charged. Of 4 this additional fee, $2 shall be deposited into the Secretary 5 of State Special License Plate Fund and $18 shall be 6 deposited into the Phi Kappa Psi Fraternity Scholarship Fund. 7 (d) The Phi Kappa Psi Fraternity Scholarship Fund is 8 created as a special fund in the State treasury. All moneys 9 in the Phi Kappa Psi Fraternity Scholarship Fund shall, 10 subject to appropriation by the General Assembly and approval 11 by the Secretary, be used by the Phi Kappa Psi Fraternity 12 Scholarship Foundation Inc., a recognized charitable 13 organization that meets the requirements of Title 26, Section 14 501(c)(3) of the United States Code, to provide grants for 15 scholarships for higher education. The scholarship recipients 16 must be undergraduate members of an Illinois Chapter of Phi 17 Kappa Psi and must be Illinois residents and must attend a 18 college or university located within the State of Illinois. 19 The State Treasurer shall require the Phi Kappa Psi 20 Fraternity Scholarship Foundation to establish a separate 21 account for receipt of the proceeds of the Phi Kappa Psi 22 Fraternity Scholarship Fund. That account shall be subject to 23 audit either annually or at another interval, as determined 24 by the State Treasurer. Proceeds from the Phi Kappa Psi 25 Fraternity Scholarship Fund shall be transferred on a 26 quarterly basis by the State Treasurer's office to this 27 separate account.
