92_HB3608 LRB9208324DHmb 1 AN ACT concerning special districts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Regional Transportation Authority Act is 5 amended by changing Section 1.05 as follows: 6 (70 ILCS 3615/1.05) (from Ch. 111 2/3, par. 701.05) 7 Sec. 1.05. Referendum on Establishment. A special 8 referendum election shall be held at which there shall be 9 submitted to the electors in the metropolitan region the 10 proposition to approve creation of the Authority, which 11 proposition shall be in substantially the following form: 12 Shall a Regional Transportation Authority be created for 13 Cook, DuPage, Kane, Lake, McHenry and Will Counties, 14 Illinois? 15 The special referendum election shall be conducted by the 16 County Clerks and Boards of Election Commissioners in the 17 metropolitan region pursuant to the provisions of"the 18 Election Code",approved May 11, 1943, as amended,except as 19 is specifically provided otherwise in this Section. The 20 special referendum election shall be held at the same time 21 and with the same judges, polling places and precincts as for 22 the regular primary elections to be held on March 19, 1974, 23 in the metropolitan region. 24 The proposition shall be submitted to the electors on a 25 separate paper ballot to be printed on blue paper. The State 26 Board of Elections shall prepare and certify the form of 27 ballot to the County Clerks and Boards of Election 28 Commissioners in the metropolitan region. 29 Notice of the referendum election shall be given by the 30 State Board of Elections. In addition, such notice may be 31 given by the County Clerks and Boards of Election -2- LRB9208324DHmb 1 Commissioners. Each notice of the special election shall set 2 forth the proposition to be voted upon, the date of the 3 election and the time the polling places will be open and 4 shall state that the polling places and precincts for such 5 election shall be the same as for the primary elections held 6 on such date. The notice given by the State Board of 7 Elections shall be published in one or more daily newspapers 8 of general circulation in the metropolitan region at least 9 once not less than 20 days prior to the election. Notice of 10 the special referendum election need not set forth the 11 precincts or polling places in detail. Notices given by 12 County Clerks or Boards of Election Commissioners shall be in 13 the form prescribed by the State Board of Elections. 14 The votes shall be canvassed and returned in the manner 15 provided for public measures submitted to the electors of the 16 entire State, including the provisions for tally sheets, 17 certificates of results, canvassing and abstracts of votes. 18 Only those ballots properly marked yes or no shall be counted 19 in the referendum. Each municipal Board of Election 20 Commissioners shall make its return to the County Clerk of 21 the County in which it is located; the County Clerks and any 22 County Board of Election Commissioners shall each make 23 returns covering their entire county to the State Board of 24 Elections. Each County Clerk and Board of Election 25 Commissioners shall prepare and certify an abstract of votes 26 cast on the proposition in the precincts within its election 27 jurisdiction. The County Clerks and any county Board of 28 Election Commissioners shall transmit the certified abstracts 29 to the State Board of Elections with its return within 10 30 days of the referendum. To meet this deadline, the County 31 Clerks and Boards of Election Commissioners shall canvass the 32 votes cast in the special referendum election prior to 33 canvassing the votes cast for any office in the regular 34 primary election, and may certify the results of and make -3- LRB9208324DHmb 1 returns on the special referendum election prior to 2 completing those procedures for the regular primary 3 elections. 4 The State Board of Elections shall proclaim and certify 5 the results of the referendum election. If a majority of 6 those electors properly marking ballots on the proposition 7 vote in favor of the creation of the Authority, such 8 Authority shall thereby be established. 9 (Source: P.A. 78-3rd S.S.-5.)
