92_HB3375enr HB3375 Enrolled LRB9200919TAtm 1 AN ACT concerning state facilities. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Department of Central Management Services 5 Law of the Civil Administrative Code of Illinois is amended 6 by changing Section 405-315 as follows: 7 (20 ILCS 405/405-315) (was 20 ILCS 405/67.24) 8 Sec. 405-315. Management of State buildings; security 9 force; fees. 10 (a) To manage, operate, maintain, and preserve from 11 waste the State buildings listed below. The Department may 12 rent portions of these and other State buildings when in the 13 judgment of the Director those leases will be in the best 14 interests of the State. The leases shall not exceed 5 years 15 unless a greater term is specifically authorized. 16 a. Peoria Regional Office Building 17 5415 North University 18 Peoria, Illinois 61614 19 b. The Communications Center 25 120 West Jefferson 26 Springfield, Illinois 27 s. Portions or all of the basement and 28 ground floor of the 29 State of Illinois Building 30 160 North LaSalle 31 Chicago, Illinois 60601 32 may be leased to persons, firms, partnerships, associations, 33 or individuals for terms not to exceed 15 years when in the 34 judgment of the Director those leases will be in the best HB3375 Enrolled -4- LRB9200919TAtm 1 interests of the State. 2 Portions or all of the commercial space, which includes 3 the sub-basement, storage mezzanine, concourse, and ground 4 and second floors of the 5 James R. Thompson Center 6 Bounded by Lake, Clark, Randolph and LaSalle Streets 7 Chicago, Illinois 8 may be leased to persons, firms, partnerships, associations, 9 or individuals for terms not to exceed 15 years subject to 10 renewals when in the judgment of the Director those leases 11 will be in the best interests of the State. 12 The Director is authorized to rent portions of the above 13 described facilities to persons, firms, partnerships, 14 associations, or individuals for terms not to exceed 30 days 15 when those leases will not interfere with State usage of the 16 facility. This authority is meant to supplement and shall not 17 in any way be interpreted to restrict the Director's ability 18 to make portions of the State of Illinois Building and the 19 James R. Thompson Center available for long-term commercial 20 leases. 21 Provided however, that all rentals or fees charged to 22 persons, firms, partnerships, associations, or individuals 23 for any lease or use of space in the above described 24 facilities made for terms not to exceed 30 days in length 25 shall be deposited in a special fund in the State treasury to 26 be known as the Special Events Revolving Fund. 27 Notwithstanding the provisions above, the Department of 28 Children and Family Services and the Department of Human 29 Services (as successor to the Department of Rehabilitation 30 Services and the Department of Mental Health and 31 Developmental Disabilities) shall determine the allocation of 32 space for direct recipient care in their respective 33 facilities. The Department of Central Management Services 34 shall consult with the affected agency in the allocation and HB3375 Enrolled -5- LRB9200919TAtm 1 lease of surplus space in these facilities. Potential lease 2 arrangements shall not endanger the direct recipient care 3 responsibilities in these facilities. 4 (b) To appoint, subject to the Personnel Code, persons 5 to be members of a police and security force. Members of the 6 security force shall be peace officers when performing duties 7 pursuant to this Section and as such shall have all of the 8 powers possessed by policemen in cities and sheriffs, 9 including the power to make arrests on view or issue 10 citations for violations of State statutes or city or county 11 ordinances, except that in counties of more than 1,000,000 12 population, any powers created by this subsection shall be 13 exercised only (i) when necessary to protect the property, 14 personnel, or interests of the Department or any State agency 15 for whom the Department manages, operates, or maintains 16 property or (ii) when specifically requested by appropriate 17 State or local law enforcement officials, and except that 18 within counties of 1,000,000 or less population, these powers 19 shall be exercised only when necessary to protect the 20 property, personnel, or interests of the State of Illinois 21 and only while on property managed, operated, or maintained 22 by the Department. 23 Nothing in this subsection shall be construed so as to 24 make it conflict with any provisions of, or rules promulgated 25 under, the Personnel Code. 26 (c) To charge reasonable fees to all State agencies 27 utilizing facilities operated by the Department for occupancy 28 related fees and charges. All fees collected under this 29 subsection shall be deposited in a special fund in the State 30 treasury known as the Facilities Management Revolving Fund. 31 As used in this subsection, the term "State agencies" means 32 all departments, officers, commissions, institutions, boards, 33 and bodies politic and corporate of the State. 34 (Source: P.A. 91-239, eff. 1-1-00.)
