 1        AN ACT in relation to vehicle emissions.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Vehicle  Code  is amended by
 5    changing Section 13B-5 as follows:

 6        (625 ILCS 5/13B-5)
 7        Sec.  13B-5.  Definitions.  For  the  purposes  of   this
 8    Chapter:
 9        "Affected  counties"  means  Cook  County; DuPage County;
10    Lake County; those parts of Kane County that are not included
11    within any of the following ZIP code areas, as designated  by
12    the  U.S.  Postal  Service  on  the  effective  date  of this
13    amendatory Act of 1994: 60109, 60119,  60135,  60140,  60142,
14    60144,  60147,  60151,  60152,  60178,  60182,  60511, 60520,
15    60545, and 60554; those parts of Kendall County that are  not
16    included  within  any  of  the  following  ZIP code areas, as
17    designated by the U.S. Postal Service on the  effective  date
18    of  this  amendatory Act of 1994: 60447, 60512, 60536, 60537,
19    60541, those parts of 60543 that are not  within  the  census
20    defined  urbanized  area,  60545,  and  60560; those parts of
21    McHenry County that  are  not  included  within  any  of  the
22    following  ZIP  code  areas, as designated by the U.S. Postal
23    Service on the effective date of this amendatory Act of 1994:
24    60001, 60033,  60034,  60071,  60072,  60097,  60098,  60142,
25    60152,  and  60180;  those  parts of Will County that are not
26    included within any of  the  following  ZIP  code  areas,  as
27    designated  by  the U.S. Postal Service on the effective date
28    of this amendatory Act of 1994: 60401, 60407,  60408,  60410,
29    60416,  60418,  60421,  60442, 60447, 60468, 60481, 60935 and
30    60950; those parts of Madison County that  are  not  included
31    within  any of the following ZIP code areas, as designated by

 1    the U.S.  Postal  Service  on  the  effective  date  of  this
 2    amendatory  Act  of  1994: 62001, 62012, 62021, 62026, 62046,
 3    62058, 62061, 62067, 62074, 62088, 62097, 62249,  62275,  and
 4    62281;  those  parts  of  Monroe County that are not included
 5    within any of the following ZIP code areas, as designated  by
 6    the  U.S.  Postal  Service  on  the  effective  date  of this
 7    amendatory Act of 1994: 62244, 62248,  62256,  62261,  62276,
 8    62278,  62279, 62295, and 62298; and those parts of St. Clair
 9    County that are not included within any of the following  ZIP
10    code  areas,  as designated by the U.S. Postal Service on the
11    effective date of this amendatory Act of 1994: 62224,  62243,
12    62248,  62254,  62255,  62257,  62258,  62260,  62264, 62265,
13    62269, 62278, 62282, 62285, 62289, and 62298.
14        "Board" means the Illinois Pollution Control Board.
15        "Inspection area" means Cook County, DuPage County,  Lake
16    County and those portions of Kane, Kendall, Madison, McHenry,
17    Monroe,   Will,  and  St.  Clair  Counties  included  in  the
18    definition of "affected counties".
19        "Owner" means the registered owner  of  the  vehicle,  as
20    indicated  on  the  vehicle's registration. In the case of an
21    unregistered vehicle, "owner" has the meaning  set  forth  in
22    Section 1-155 of this Code.
23        "Program"  means  the vehicle emission inspection program
24    established under this Chapter.
25        "Resident" includes natural persons, foreign and domestic
26    corporations,  partnerships,  associations,  and  all   other
27    commercial  and  governmental  entities.  For  the purpose of
28    determining residence,  the  owner  of  a  vehicle  shall  be
29    presumed  to reside at the address indicated on the vehicle's
30    registration. A governmental entity,  including  the  federal
31    government and its agencies, and any unit of local government
32    or  school  district,  any part of which is located within an
33    affected county, shall be deemed a resident  of  an  affected
34    county  for  the  purpose of any vehicle that is owned by the

 1    governmental entity and regularly  operated  in  an  affected
 2    county.
 3        "Registration"  of a vehicle means its registration under
 4    Article IV of Chapter 3 of this Code.

 6        Section 10.  The Illinois  Vehicle  Code  is  amended  by
 7    changing Section 13B-25 as follows:

 8        (625 ILCS 5/13B-25)
 9        Sec. 13B-25. Performance of inspections.
10        (a)  The  inspection  of  vehicles  required  under  this
11    Chapter  shall  be performed only: (i) by inspectors who have
12    been certified by the Agency after successfully completing  a
13    course  of  training and successfully passing a written test;
14    (ii) at official  inspection  stations  or  official  on-road
15    inspection  sites  established  under this Chapter; and (iii)
16    with equipment that has been approved by the Agency for these
17    inspections.
18        (b)  Except as provided in subsections (c) and  (d),  the
19    inspection  shall  consist  of  (i) a loaded mode exhaust gas
20    analysis; (ii) an evaporative system integrity test; (iii) an
21    on-board  computer  diagnostic  system  check;  and  (iv)   a
22    verification   that   all  required  emission-related  recall
23    repairs have been made under Title 40, Section 51.370 of  the
24    Code   of  Federal  Regulations,  and  may  also  include  an
25    evaporative system purge test. The owner of  the  vehicle  or
26    the owner's agent shall be entitled to an emission inspection
27    certificate issued by an inspector only if all required tests
28    are passed at the time of the inspection.
29        (c)  A  steady-state  idle  exhaust  gas  analysis may be
30    substituted for the loaded mode exhaust gas analysis and  the
31    evaporative purge system test in the following cases:
32             (1)  On any vehicle of model year 1980 or older.

 1             (2)  On  any  heavy duty vehicle with a manufacturer
 2        gross vehicle weight rating in excess of 8,500 pounds.
 3             (3)  On any vehicle for which loaded mode testing is
 4        not possible due to vehicle design or configuration.
 5        (d)  If authorized by  the  United  States  Environmental
 6    Protection  Agency  with  no  or  a  minimal loss of emission
 7    reduction benefits and if authorized by rules that the  Board
 8    or  the  Agency  may adopt, the following procedures shall be
 9    followed on model year 1996 and newer vehicles equipped  with
10    OBDII on-board computer diagnostic equipment:
11             (1)  The  loaded mode exhaust gas analysis specified
12        in subsection (b) of this Section shall not be  performed
13        on   such   vehicles  for  which  the  on-board  computer
14        diagnostic test  specified  in  subsection  (h)  of  this
15        Section  can  be  performed.  All  other  elements of the
16        inspection required for such vehicles shall be  performed
17        in accordance with the provisions of this Section.
18             (2)  The on-board computer diagnostic test shall not
19        be  a required element of the inspection mandated by this
20        Section for such vehicles  for  which  on-board  computer
21        diagnostic  testing  is not possible due to the vehicle's
22        originally certified design or its design as modified  in
23        accordance  with  federal  law  and  regulations. In such
24        cases, all other  elements  of  the  inspection  required
25        under  this  Section shall be performed on such vehicles,
26        including  the  exhaust  gas  analysis  as  specified  in
27        subsection (b) of this Section.  A steady-state idle  gas
28        analysis  may  also be substituted for the new procedures
29        specified in subsection (b) in inspections  conducted  in
30        calendar  year  1995 on any vehicle of model year 1990 or
31        older.
32        (e)  The exhaust gas analysis shall consist of a test  of
33    an  exhaust gas sample to determine whether the quantities of
34    exhaust gas  pollutants  emitted  by  the  vehicle  meet  the

 1    standards set for vehicles of that type under Section 13B-20.
 2    A  vehicle shall be deemed to have passed this portion of the
 3    inspection if  the  evaluation  of  the  exhaust  gas  sample
 4    indicates  that  the  quantities  of  exhaust  gas pollutants
 5    emitted by the vehicle do not exceed the  standards  set  for
 6    vehicles  of  that  type under Section 13B-20 or an inspector
 7    certifies that the vehicle qualifies  for  a  waiver  of  the
 8    exhaust gas pollutant standards under Section 13B-30.
 9        (f)  The  evaporative system integrity test shall consist
10    of a procedure to determine  if  leaks  exist  in  all  or  a
11    portion  of  the  vehicle  fuel  evaporation emission control
12    system.  A vehicle shall be deemed to have passed  this  test
13    if  it  meets  the  criteria  that the Board may adopt for an
14    evaporative system integrity test.
15        (g)  The evaporative system purge test shall consist of a
16    procedure to verify the  purging  of  vapors  stored  in  the
17    evaporative  canister.   A  vehicle  shall  be deemed to have
18    passed this test if it meets the criteria that the Board  may
19    adopt for an evaporative system purge test.
20        (h)  The  on-board computer diagnostic test shall consist
21    of accessing the vehicle's on-board computer  system,  if  so
22    equipped, and reading any stored diagnostic codes that may be
23    present.   The  vehicle  shall  be deemed to have passed this
24    test if the codes observed did not exceed standards  set  for
25    vehicles of that type under Section 13B-20.

27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law, except that Section  5  takes  effect  90  days
29    after becoming law.
