92_HB3224 LRB9201015TAtm 1 AN ACT concerning legal advocacy services. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Guardianship and Advocacy Act is amended 5 by changing Section 34 as follows: 6 (20 ILCS 3955/34) (from Ch. 91 1/2, par. 734) 7 Sec. 34. (a) A person, who in good faith, files a 8 complaint or provides information to the Commission or any 9 division thereof, including private citizens and employees of 10 service providers, shall not be subject to any penalties, 11 sanctions, or restrictions as a consequence of filing the 12 complaint or providing the information. 13 (b) No attorney or paralegal employed by the Commission, 14 acting within the scope of his or her employment or contract, 15 nor any person or entity employing, supervising, assisting, 16 or contracting for the services of any attorney or paralegal 17 employed by the Commission, is liable for any damages in 18 tort, contract, or otherwise, in which the plaintiff seeks 19 damages by reason of legal or professional malpractice, 20 except for willful and wanton misconduct. 21 (Source: P.A. 80-1416.) 22 Section 99. Effective date. This Act takes effect upon 23 becoming law.
