 1        AN ACT in relation to sheriffs.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Counties  Code  is  amended  by  changing
 5    Sections 3-6037 and 4-6003 as follows:

 6        (55 ILCS 5/3-6037) (from Ch. 34, par. 3-6037)
 7        Sec. 3-6037.  Salary of Supervisor of Safety.  The county
 8    board  may,  but  need not, allow the Supervisor of Safety an
 9    annual salary.  Beginning December 1,  2001,  if  the  county
10    board  allows the Supervisor of Safety an annual salary, that
11    annual salary shall not  be  less  than  not  to  exceed  the
12    following:
13        In  counties  of  less than 20,000 population, the sum of
14    $1,500;
15        In counties of  20,000  or  more  and  less  than  30,000
16    population, the sum of $2,000;
17        In  counties  of  30,000  or  more  and  less than 50,000
18    population, the sum of $2,500;
19        In counties of  50,000  or  more  and  less  than  75,000
20    population, the sum of $3,000;
21        In  counties  of  75,000  or  more  and less than 100,000
22    population, the sum of $3,500;
23        In counties of 100,000 or  more  and  less  than  500,000
24    population, the sum of $4,000;
25        In  counties  of  500,000  or more population, the sum of
26    $4,500.
27        The word "population" when used  in  this  section  shall
28    mean  the  population  as  determined  by  the last preceding
29    Federal Census.
30        These salaries shall be without regard  to  and  separate
31    from  the  salaries that may be fixed by the county board for

 1    the Sheriff, and shall be payable out of the County Treasury.

 4        Sec.  4-6003.  Compensation  of  sheriffs   for   certain
 5    expenses in counties of less than 2,000,000.
 6        (a)  The  County  Board,  in  all  counties  of less than
 7    2,000,000  inhabitants,  shall  fix   the   compensation   of
 8    sheriffs,  with  the  amount  of  their necessary clerk hire,
 9    stationery, fuel and other expenses.  The county shall supply
10    the sheriff with all necessary uniforms, guns and ammunition.
11    The  compensation  of  each  such  officer  shall  be   fixed
12    separately  from  his  necessary clerk hire, stationery, fuel
13    and other expenses.  Beginning immediately, no county with  a
14    population   under   2,000,000   may   reduce   the  rate  of
15    compensation of its sheriff below the  rate  of  compensation
16    that  it  was actually paying to its sheriff on the effective
17    date of this amendatory Act of the 92nd General Assembly.
18        (b)  In addition to the requirement  of  subsection  (a),
19    the rate of compensation payable to the sheriff by the county
20    shall  not  be  less  than  the  following, as adjusted under
21    subsection (c) and such compensation shall  be  fixed  within
22    the following limits:
23        To  each  such  sheriff  in counties containing less than
24    10,000 inhabitants, not less than $27,000 per annum.
25        To each such sheriff in  counties  containing  10,000  or
26    more  inhabitants  but less than 20,000 inhabitants, not less
27    than $31,000 per annum.
28        To each such sheriff in  counties  containing  20,000  or
29    more  inhabitants  but less than 30,000 inhabitants, not less
30    than $34,000 per annum.
31        To each such sheriff in  counties  containing  30,000  or
32    more  inhabitants  but less than 60,000 inhabitants, not less
33    than $37,000 per annum.

 1        To each such sheriff in  counties  containing  60,000  or
 2    more  inhabitants but less than 100,000 inhabitants, not less
 3    than $40,000 per annum.
 4        To each such sheriff in counties  containing  100,000  or
 5    more  inhabitants  but  less  than 2,000,000 inhabitants, not
 6    less than $43,000 per annum.
 7        The population of each county for the purpose  of  fixing
 8    compensation as herein provided, shall be based upon the last
 9    federal  census  immediately  previous to the election of the
10    sheriff in question in such county.
11        (c)  The minimum rate of annual compensation for sheriffs
12    provided under subsection (b) shall be increased on  December
13    1,  2003,  and  on  each December 1 thereafter, by the annual
14    cost of living adjustment specified in this subsection.
15        The  annual  cost  of  living  adjustment  shall   be   a
16    percentage  increase  in  the  minimum  salary  equal  to the
17    percentage increase, if any, in  the  cost  of  living  index
18    known  as  the "Employment Cost Index, Wages and Salaries, by
19    Occupation and Industry Group:  State  and  Local  Government
20    Workers:   Public Administration", as published by the United
21    States Department of Labor, Bureau of Labor  Statistics,  for
22    the  12  months  ending  with the month of June preceding the
23    December in which the adjustment  is  to  take  effect.   The
24    annual  cost  of living adjustment shall take effect December
25    1, except that the actual salary paid to any  person  holding
26    the   office  of  sheriff  on  the  effective  date  of  this
27    amendatory Act of the 92nd General Assembly shall not include
28    the annual cost of living adjustment until the expiration  of
29    that term.
30        (b)  Those  sheriffs  beginning  a  term of office before
31    December 1, 1990 shall be compensated at the  rate  of  their
32    base salary.  "Base salary" is the compensation paid for each
33    of those offices, respectively, before July 1, 1989.
34        (c)  Those  sheriffs  beginning  a  term  of office on or

 1    after December 1, 1990 shall be compensated as follows:
 2             (1)  Beginning December 1, 1990, base salary plus at
 3        least 3% of base salary.
 4             (2)  Beginning December 1, 1991, base salary plus at
 5        least 6% of base salary.
 6             (3)  Beginning December 1, 1992, base salary plus at
 7        least 9% of base salary.
 8             (4)  Beginning December 1, 1993, base salary plus at
 9        least 12% of base salary.
10        (d)  In  addition  to  the   salary   provided   for   in
11    subsections  (a),  (b),  and (c), beginning December 1, 1998,
12    each sheriff for their additional  duties  imposed  by  other
13    statutes  or  laws shall receive an annual stipend to be paid
14    by the State in the amount of $6,500.
15        (e)  No county board may reduce or otherwise  impair  the
16    compensation  payable  from  county funds to a sheriff if the
17    reduction  or  impairment  is  the  result  of  the   sheriff
18    receiving an award or stipend payable from State funds.

20        Section  90.  The State Mandates Act is amended by adding
21    Section 8.25 as follows:

22        (30 ILCS 805/8.25 new)
23        Sec. 8.25. Exempt mandate.   Notwithstanding  Sections  6
24    and  8 of this Act, no reimbursement by the State is required
25    for  the  implementation  of  any  mandate  created  by  this
26    amendatory Act of the 92nd General Assembly.

27        Section 99. Effective date.  This Act takes  effect  upon
28    becoming law.
