92_HB2860 LRB9201891RCcs 1 AN ACT concerning racial profiling. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 adding Section 11-212 as follows: 6 (625 ILCS 5/11-212 new) 7 Sec. 11-212. Traffic stop statistical study. 8 (a) From June 1, 2001 until 4 years after the effective 9 date of this amendatory Act of the 92nd General Assembly, 10 whenever a law enforcement officer of this State or a unit of 11 local government issues a uniform traffic citation or warning 12 citation for an alleged violation of the Illinois Vehicle 13 Code or a similar provision of a local ordinance, he or she 14 shall record on the face of the citation in addition to other 15 information the following: 16 (1) the race of the motorist; and 17 (2) whether there was a search of the vehicle, 18 vehicle driver, or passenger resulting in no further 19 legal action. 20 (b) From June 8, 2002 until 3 years after the effective 21 date of this amendatory Act of the 92nd General Assembly, the 22 Director of State Police and each police chief and county 23 sheriff shall compile the data collected under clauses (1) 24 and (2) of subsection (a) and forward the data to the 25 Secretary of State. 26 (c) Upon receiving the data specified in subsection (b), 27 the Secretary of State shall, by February 8 of each year 28 until 3 years after the effective date of this amendatory Act 29 of the 92nd General Assembly, compile and study the traffic 30 stop data to determine whether there is a pattern of 31 discrimination throughout the State in the enforcement of -2- LRB9201891RCcs 1 this Code and similar provisions of local ordinances and send 2 the findings, in a report, to the Governor, the President of 3 the Senate, the Speaker of the House of Representatives, the 4 Minority Leader of the Senate, and the Minority Leader of the 5 House of Representatives. 6 (d) The report shall not contain any information 7 regarding the identity of any individual who has been stopped 8 or of any law enforcement officer. 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.
