1 AN ACT in relation to the environment.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by changing Section 12.1 as follows:
6 (415 ILCS 5/12.1) (from Ch. 111 1/2, par. 1012.1)
7 Sec. 12.1. (a) Beginning Commencing June 30, 1984 and
8 until January 1, 1986, no person shall cause, threaten, or
9 allow the underground injection of hazardous waste unless:
10 (1) the underground injection is into an existing well
11 or a replacement well; and
12 (2) the underground injection will not violate this Act
13 or any regulation or standard adopted by the Board under this
14 Act.
15 (b) For purposes of this Section, an existing well is a
16 well that is in existence on the effective date of this
17 amendatory Act of 1984.
18 (c) For purposes of this Section, a replacement well is
19 a well that:
20 (1) replaces an existing inoperative or stand-by well;
21 and
22 (2) is located within the same site as the inoperative
23 existing well.
