 1                    AMENDMENT TO HOUSE BILL 2538

 2        AMENDMENT NO.     .  Amend House Bill 2538,  AS  AMENDED,
 3    with  reference  to  page and line numbers of House Amendment
 4    No. 1,  on  page  3,  by  replacing  lines  11  and  12  with
 5    "appropriate.  Failure to abide"; and

 6    on  page  3,  line  32,  after  "appoint"  by inserting ", in
 7    writing,"; and

 8    on page 5, line 10, by deleting "21.2,"; and

 9    on page 5, line 11, by changing "Sections 4.9  and  48.7"  to
10    "Section 48.7" and

11    by deleting lines 26 through 33 on page 15 and line 1 on page
12    16; and

13    by deleting lines 6 through 11 on page 27; and

14    on  page  31,  lines  3,  4,  and  5  by replacing "or as the
15    resulting bank in a merger with an  existing  national  bank"
16    with ", national bank, trust company,"; and

17    on  page 46, lines 23 through 25, by deleting "to ensure that
18    such issuance is consistent with applicable statutes,  rules,
19    and policies"; and

20    on  page  52,  line 8, after "obligation" by inserting "until

 1    the Commissioner takes action on the application"; and

 2    on page 52, by replacing lines 18 and 19 with  "necessary  or
 3    appropriate."; and

 4    by  deleting  lines  14  through  33  on  page 57 and lines 1

 6    on page 60, by replacing lines  24  through  26  with  "deems
 7    necessary or appropriate."; and

 8    on  page  60, line 34, after "obligation" by inserting "until
 9    the Commissioner takes action on the application"; and

10    on page 66, line 15, by replacing "and" with "or"; and

11    on page  66,  by  replacing  lines  19  and  20  with  "bank,
12    including the acquisition of"; and

13    on  page  66,  by  replacing  lines  25  and  26  with "bank,
14    including the acquisition of"; and

15    on  page  71,  line  4,  after  "occurrence."  by   inserting
16    "Compliance  with  the  time  frames prescribed by the United
17    States Department of Treasury's Financial Crimes  Enforcement
18    Network shall be deemed compliance with this Section."; and

19    on  page  81,  by  replacing  lines  4  through  6  with "are
20    necessary or appropriate. These conditions shall  be  imposed
21    in writing"; and

22    on page 81, by deleting lines 17 through 21; and

23    on  page  81,  line  29, after "authorize" by inserting ", in
