92_HB2407 LRB9205412NTsb 1 AN ACT regarding higher education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Public Community College Act is amended 5 by adding Section 2-12.2 as follows: 6 (110 ILCS 805/2-12.2 new) 7 Sec. 2-12.2. New district; former Metropolitan Community 8 College District No. 541. 9 (a) The State Board shall establish a new community 10 college district, to be known as Gateway Community College, 11 to be comprised of the territory of former Metropolitan 12 Community College District No. 541 established under Section 13 2-12.1. The State Board may not abolish, restrict, or take 14 over the operation of Gateway Community College without first 15 notifying the General Assembly and receiving permission from 16 the General Assembly for the action. 17 (b) The State Board shall provide financial and 18 technical assistance to Gateway Community College in becoming 19 established. The State Board shall transfer to Gateway 20 Community College all documents, equipment, and books and any 21 other personal property that was in the possession of or 22 owned by former Metropolitan Community College District No. 23 541 at the time that it was abolished. If the State Board 24 fails to transfer the documents, equipment, books, or any 25 other personal property to Gateway Community College, the 26 State Board shall make a full accounting of the items not 27 placed in the physical and legal custody of Gateway Community 28 College to the governing board of Gateway Community College, 29 with an estimate of the replacement cost of the items, and 30 shall credit the accounts of Gateway Community College in 31 that amount. The State Board shall, upon the date of the -2- LRB9205412NTsb 1 establishment of Gateway Community College, convey to Gateway 2 Community College the real estate and improvements that 3 comprised the campus of former Metropolitan Community College 4 District No. 541 at the time that it was abolished. 5 (c) The State Board shall adopt all rules necessary to 6 carry out its responsibilities under this Section.
