92_HB2295enr HB2295 Enrolled LRB9205091ARsb 1 AN ACT concerning criminal law. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Code of 1961 is amended by 5 changing Section 20-1.1 as follows: 6 (720 ILCS 5/20-1.1) (from Ch. 38, par. 20-1.1) 7 Sec. 20-1.1. Aggravated Arson. (a) A person commits 8 aggravated arson when in the course of committing arson he 9 knowingly damages, partially or totally, any building or 10 structure, including any adjacent building or structure, 11 including all or any part of a house trailer, watercraft, 12 motor vehicle, or railroad car, and (1) he knows or 13 reasonably should know that one or more persons are present 14 therein or (2) any person suffers great bodily harm, or 15 permanent disability or disfigurement as a result of the fire 16 or explosion or (3) a fireman or policeman who is present at 17 the scene acting in the line of duty, is injured as a result 18 of the fire or explosion. For purposes of this Section, 19 property "of another" means a building or other property, 20 whether real or personal, in which a person other than the 21 offender has an interest that the offender has no authority 22 to defeat or impair, even though the offender may also have 23 an interest in the building or property. 24 (b) Sentence. Aggravated arson is a Class X felony. 25 (Source: P.A. 84-1100.) 26 Section 99. Effective date. This Act takes effect upon 27 becoming law.
