92_HB2162 LRB9201782MWpc 1 AN ACT concerning elections. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Election Code is amended by changing 5 Section 10-14 as follows: 6 (10 ILCS 5/10-14) (from Ch. 46, par. 10-14) 7 Sec. 10-14. Not less than 6761days before the date of 8 the general election the State Board of Elections shall 9 certify to the county clerk of each county the name of each 10 candidate whose nomination papers, certificate of nomination 11 or resolution to fill a vacancy in nomination has been filed 12 with the State Board of Elections and direct the county clerk 13 to place upon the official ballot for the general election 14 the names of such candidates in the same manner and in the 15 same order as shown upon the certification. The name of no 16 candidate for an office to be filled by the electors of the 17 entire state shall be placed upon the official ballot unless 18 his name is duly certified to the county clerk upon a 19 certificate signed by the members of the State Board of 20 Elections. The names of group candidates on petitions shall 21 be certified to the several county clerks in the order in 22 which such names appear on such petitions filed with the 23 State Board of Elections. 24 Not less than 6155days before the date of the general 25 election, each county clerk shall certify the names of each 26 of the candidates for county offices whose nomination papers, 27 certificates of nomination or resolutions to fill a vacancy 28 in nomination have been filed with such clerk and declare 29 that the names of such candidates for the respective offices 30 shall be placed upon the official ballot for the general 31 election in the same manner and in the same order as shown -2- LRB9201782MWpc 1 upon the certification. Each county clerk shall place a copy 2 of the certification on file in his or her office and at the 3 same time issue to the State Board of Elections a copy of 4 such certification. In addition, each county clerk in whose 5 county there is a board of election commissioners shall, not 6 less than 6155days before the election, certify to the 7 board of election commissioners the name of the person or 8 persons nominated for such office as shown by the certificate 9 of the State Board of Elections, together with the names of 10 all other candidates as shown by the certification of county 11 officers on file in the clerk's office, and in the order so 12 certified. The county clerk or board of election 13 commissioners shall print the names of the nominees on the 14 ballot for each office in the order in which they are 15 certified to or filed with the county clerk; provided, that 16 in printing the name of nominees for any office, if any of 17 such nominees have also been nominated by one or more 18 political parties pursuant to this Act, the location of the 19 name of such candidate on the ballot for nominations made 20 under this Article shall be precisely in the same order in 21 which it appears on the certification of the State Board of 22 Elections to the county clerk. 23 For the general election, the candidates of new political 24 parties shall be placed on the ballot for said election after 25 the established political party candidates and in the order 26 of new political party petition filings. 27 Each certification shall indicate, where applicable, the 28 following: 29 (1) The political party affiliation if any, of the 30 candidates for the respective offices; 31 (2) If there is to be more than one candidate elected to 32 an office from the State, political subdivision or district; 33 (3) If the voter has the right to vote for more than one 34 candidate for an office; -3- LRB9201782MWpc 1 (4) The term of office, if a vacancy is to be filled for 2 less than a full term or if the offices to be filled in a 3 political subdivision are for different terms. 4 The State Board of Elections or the county clerk, as the 5 case may be, shall issue an amended certification whenever it 6 is discovered that the original certification is in error. 7 (Source: P.A. 86-867.) 8 Section 99. Effective date. This Act takes effect upon 9 becoming law.
