92_HB2148 LRB9204189LBmg 1 AN ACT concerning the regulation of professions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Plumbing License Law is amended 5 by changing Sections 1, 2, 3, 8, 14, and 20 and by adding 6 Section 13.1 as follows: 7 (225 ILCS 320/1) (from Ch. 111, par. 1101) 8 Sec. 1. Purpose. It has been established by scientific 9 evidence that improper plumbing can result in the 10 introduction of pathogenic organisms into the potable water 11 supply, result in the escape of toxic gases into the 12 environment, and result in potentially lethal disease and 13 epidemic. It is further found that minimum numbers of 14 plumbing facilities and fixtures are necessary for the 15 comfort and convenience of workers and persons in public 16 places. 17 Consistent with its duty to safeguard the health of the 18 people of this State, the General Assembly therefore declares 19 that the regulation of plumbing and the plumbing trade is 20 necessary for the protection of the public health, 21 convenience, and welfare. The General Assembly therefore 22 declares that individuals who plan, inspect, install, alter, 23 extend, repair and maintain plumbing systems shall be 24 individuals of proven skill. Further, the General Assembly 25 declares that a guide for the minimum control and number of 26 plumbing materials and fixtures, the design of plumbing 27 systems, and the construction and installation methods of 28 plumbing systems is essential for the protection of public 29 health and convenience. In order to insure plumbing skill and 30 to authoritatively establish what shall be good plumbing 31 practice, this Act provides for the licensing of plumbers and -2- LRB9204189LBmg 1 plumbing contractors and for the promulgation of a Minimum 2 Plumbing Code of standards by the Department.,This Act is 3 therefore declared to be essential to the public interest. 4 (Source: P.A. 87-885.) 5 (225 ILCS 320/2) (from Ch. 111, par. 1102) 6 Sec. 2. When used in this Act: 7 "Agent" means a person designated by a sponsor as 8 responsible for supervision of an apprentice plumber and who 9 is also an Illinois licensed plumber. 10 "Apprentice plumber" means any licensed person who is 11 learning and performing plumbing under the supervision of a 12 sponsor or his agent in accordance with the provisions of 13 this Act. 14 "Approved apprenticeship program" means an apprenticeship 15 program approved by the U.S. Department of Labor's Bureau of 16 Apprenticeship and Training and the Department under rules. 17 "Board" means the Illinois State Board of Plumbing 18 Examiners. 19 "Building drain" means that part of the lowest horizontal 20 piping of a drainage system that receives the discharge from 21 soil, waste, and other drainage pipes inside the walls of a 22 building and conveys it to 5 feet beyond the foundation walls 23 where it is connected to the building sewer. 24 "Building sewer" means that part of the horizontal piping 25 of a drainage system that extends from the end of the 26 building drain, receives the discharge of the building drain 27 and conveys it to a public sewer or private sewage disposal 28 system. 29 "Department" means the Illinois Department of Public 30 Health. 31 "Director" means the Director of the Illinois Department 32 of Public Health. 33 "Governmental unit" means a city, village, incorporated -3- LRB9204189LBmg 1 town, county, or sanitary or water district. 2 "Irrigation contractor" means a person who installs or 3 supervises the installation of lawn sprinkler systems subject 4 to Section 2.5 of this Act, other than a licensed plumber or 5 a licensed apprentice plumber. 6 "Lawn sprinkler system" means any underground irrigation 7 system of lawn, shrubbery and other vegetation from any 8 potable water sources; and from any water sources, whether or 9 not potable, in: (i) any county with a population of 10 3,000,000 or more; (ii) any county with a population of 11 275,000 or more which is contiguous in whole or in part to a 12 county with a population of 3,000,000 or more; and (iii) any 13 county with a population of 37,000 or more but less than 14 150,000 which is contiguous to 2 or more counties with 15 respective populations in excess of 275,000. "Lawn sprinkler 16 system" includes without limitation the water supply piping, 17 valves, and sprinkler heads or other irrigation outlets, but 18 does not include the backflow prevention device. "Lawn 19 sprinkler system" does not include an irrigation system used 20 primarily for agricultural purposes. 21 "Person" means any natural person, firm, corporation, 22 partnership, or association. 23 "Plumber" means any licensed person authorized to perform 24 plumbing as defined in this Act, but does not include retired 25 plumbers as defined in this Act. 26 "Plumbing" means the actual installation, repair, 27 maintenance, alteration or extension of a plumbing system by 28 any person. 29 "Plumbing" includes all piping, fixtures, appurtenances 30 and appliances for a supply of water for all purposes, 31 including without limitation lawn sprinkler systems and 32 backflow prevention devices connected to lawn sprinkler 33 systems, from the source of a private water supply on the 34 premises or from the main in the street, alley or at the curb -4- LRB9204189LBmg 1 to, within and about any building or buildings where a person 2 or persons live, work or assemble. 3 "Plumbing" includes all piping, from discharge of pumping 4 units to and including pressure tanks in water supply 5 systems. 6 "Plumbing" includes all piping, fixtures, appurtenances, 7 and appliances for a building drain and a sanitary drainage 8 and related ventilation system of any building or buildings 9 where a person or persons live, work or assemble from the 10 point of connection of such building drain to the building 11 sewer or private sewage disposal system 5 feet beyond the 12 foundation walls. 13 "Plumbing" does not mean or include the trade of 14 drain-laying, the trade of drilling water wells which 15 constitute the sources of private water supplies, and of 16 making connections between such wells and pumping units in 17 the water supply systems of buildings served by such private 18 water supplies, or the business of installing water softening 19 equipment and of maintaining and servicing the same, or the 20 business of manufacturing or selling plumbing fixtures, 21 appliances, equipment or hardware, or to the installation and 22 servicing of electrical equipment sold by a not-for-profit 23 corporation providing electrification on a cooperative basis, 24 that either on or before January 1, 1971, is or has been 25 financed in whole or in part under the federal Rural 26 Electrification Act of 1936 and the Acts amendatory thereof 27 and supplementary thereto, to its members for use on farms 28 owned by individuals or operated by individuals, nor does it 29 mean or include minor repairs which do not require changes in 30 the piping to or from plumbing fixtures or involve the 31 removal, replacement, installation or re-installation of any 32 pipe or plumbing fixtures. Plumbing does not include the 33 installation, repair, maintenance, alteration or extension of 34 building sewers. -5- LRB9204189LBmg 1 "Plumbing contractor" means any person who performs 2 plumbing, as defined in this Act, for another person. 3 "Plumbing contractor" shall not include licensed plumbers and 4 licensed apprentice plumbers who either are employed by 5 persons engaged in the plumbing business or are employed by 6 another person for the performance of plumbing solely for 7 that other person, including, but not limited to, a hospital, 8 university, or business maintenance staff. "Plumbing 9 contractors" are required to be licensed pursuant to the 10 provisions of this Act. 11 "Plumbing fixtures" means installed receptacles, devices 12 or appliances that are supplied with water or that receive or 13 discharge liquids or liquid borne wastes, with or without 14 discharge into the drainage system with which they may be 15 directly or indirectly connected. 16 "Plumbing system" means the water service, water supply 17 and distribution pipes; plumbing fixtures and traps; soil, 18 waste and vent pipes; building drains; including their 19 respective connections, devices and appurtenances. "Plumbing 20 system" does not include building sewers as defined in this 21 Act. 22 "Retired plumber" means any licensed plumber in good 23 standing who meets the requirements of this Act and the 24 requirements prescribed by Department rule to be licensed as 25 a retired plumber and voluntarily surrenders his plumber's 26 license to the Department, in exchange for a retired 27 plumber's license. Retired plumbers cannot perform plumbing 28 as defined in this Act, cannot sponsor or supervise 29 apprentice plumbers, and cannot inspect plumbing under this 30 Act. A retired plumber cannot fulfill the requirements of 31 subsection (3) of Section 3 of this Act. 32 "Supervision" with respect to first and second year 33 licensed apprentice plumbers means that such apprentices must 34 perform all designing and planning of plumbing systems and -6- LRB9204189LBmg 1 all plumbing as defined in this Act under the direct personal 2 supervision of the sponsor or his or her agent who must also 3 be an Illinois licensed plumber, except for maintenance and 4 repair work on existing plumbing systems done by second year 5 apprentice plumbers; provided that before performing any 6 maintenance and repair work without such supervision, such 7 apprentice has received the minimum number of hours of annual 8 classroom instruction recommended by the United States 9 Department of Labor's Bureau of Apprenticeship and Training 10 for apprentice plumbers in a Bureau of Apprenticeship and 11 Training approved plumber apprenticeship program or its 12 equivalent. "Supervision" with respect to all other 13 apprentice plumbers means that, except for maintenance and 14 repair work on existing plumbing systems, any plumbing done 15 by such apprentices must be inspected daily, after initial 16 rough-in and after completion by the sponsor or his or her 17 agent who is also an Illinois licensed plumber. In addition, 18 all repair and maintenance work done by a licensed apprentice 19 plumber on an existing plumbing system must be approved by 20 the sponsor or his or her agent who is also an Illinois 21 licensed plumber. 22 "Sponsor" is an Illinois licensed plumber or an approved 23 apprenticeship program that has accepted an individual as an 24 Illinois licensed apprentice plumber for education and 25 training in the field of plumbing and whose name and license 26 number or apprenticeship program number shall appear on the 27 individual's application for an apprentice plumber's license. 28 "Sponsored" means that each Illinois licensed apprentice 29 plumber has been accepted by an Illinois licensed plumber or 30 an approved apprenticeship program for apprenticeship 31 training. 32 "Telecommunications carrier" means a telecommunications 33 carrier as defined in the Public Utilities Act. 34 (Source: P.A. 91-184, eff. 1-1-00; 91-678, eff. 1-26-00.) -7- LRB9204189LBmg 1 (225 ILCS 320/3) (from Ch. 111, par. 1103) 2 Sec. 3. (1) All planning and designing of plumbing 3 systems and all plumbing shall be performed only by plumbers 4 licensed under the provisions of this Act hereinafter called 5 "licensed plumbers" and "licensed apprentice plumbers". The 6 inspection of plumbing and plumbing systems shall be done 7 only by the sponsor or his or her agent who shall be an 8 Illinois licensed plumber. Nothing herein contained shall 9 prohibit licensed plumbers or licensed apprentice plumbers 10 under supervision from planning, designing, inspecting, 11 installing, repairing, maintaining, altering or extending 12 building sewers in accordance with this Act. No person who 13 holds a license or certificate of registration under the 14 Illinois Architecture Practice Act of 1989, or the Structural 15 Engineering Practice Act of 1989, or the Professional 16 Engineering Practice Act of 1989 shall be prevented from 17 planning and designing plumbing systems. 18 (2) Nothing herein contained shall prohibit the owner 19 occupant or lessee occupant of a single family residence, or 20 the owner of a single family residence under construction for 21 his or her occupancy, from planning, installing, altering or 22 repairing the plumbing system of such residence, provided 23 that (i) such plumbing shall comply with the minimum 24 standards for plumbing contained in the Illinois State 25 Plumbing Code, and shall be subject to inspection by the 26 Department or the local governmental unit if it retains a 27 licensed plumber as an inspector; and (ii) such owner, owner 28 occupant or lessee occupant shall not employ other than a 29 plumber licensed pursuant to this Act to assist him or her. 30 For purposes of this subsection, a person shall be 31 considered an "occupant" if and only if he or she has taken 32 possession of and is living in the premises as his or her 33 bona fide sole and exclusive residence, or, in the case of 34 an owner of a single family residence under construction for -8- LRB9204189LBmg 1 his or her occupancy, he or she expects to take possession of 2 and live in the premises as his or her bona fide sole and 3 exclusive residence, and he or she has a current intention to 4 live in such premises as his or her bona fide sole and 5 exclusive residence for a period of not less than 6 months 6 after the completion of the plumbing work performed pursuant 7 to the authorization of this subsection, or, in the case of 8 an owner of a single family residence under construction for 9 his or her occupancy, for a period of not less than 6 months 10 after the completion of construction of the residence. 11 Failure to possess and live in the premises as a sole and 12 exclusive residence for a period of 6 months or more shall 13 create a rebuttable presumption of a lack of such intention. 14 (3)The employees of a firm, association, partnership or15corporation who engage in plumbing shall be licensed plumbers16or licensed apprentice plumbers. At least one member of every17firm, association or partnership engaged in plumbing work,18and at least one corporate officer of every corporation19engaged in plumbing work, as the case may be, shall be a20licensed plumber. A retired plumber cannot fulfill the21requirements of this subsection (3).22Notwithstanding the provisions of this subsection (3), it23shall be lawful forAn irrigation contractor registered under 24 Section 2.5 of this Act may employ or contract with one or 25 more licensed plumbers in connection with work on lawn 26 sprinkler systems pursuant to Section 2.5 of this Act. 27 (4) (a) A licensed apprentice plumber shall plan, design 28 and install plumbing only under the supervision of the 29 sponsor or his or her agent who is also an Illinois 30 licensed plumber. 31 (b) An applicant for licensing as an apprentice 32 plumber shall be at least 16 years of age and apply on 33 the application form provided by the Department. Such 34 application shall verify that the applicant is sponsored -9- LRB9204189LBmg 1 by an Illinois licensed plumber or an approved 2 apprenticeship program and shall contain the name and 3 license number of the licensed plumber or program 4 sponsor. 5 (c) No licensed plumber shall sponsor more than 2 6 licensed apprentice plumbers at the same time. If 2 7 licensed apprentice plumbers are sponsored by a plumber 8 at the same time, one of the apprentices must have, at a 9 minimum, 2 years experience as a licensed apprentice. No 10 licensed plumber sponsor or his or her agent may 11 supervise 2 licensed apprentices with less than 2 years 12 experience at the same time. The sponsor or agent shall 13 supervise and be responsible for the plumbing performed 14 by a licensed apprentice. 15 (d) No agent shall supervise more than 2 licensed 16 apprentices at the same time. 17 (e) No licensed plumber may, in any capacity, 18 supervise more than 2 licensed apprentice plumbers at the 19 same time. 20 (f) No approved apprenticeship program may sponsor 21 more licensed apprentices than 2 times the number of 22 licensed plumbers available to supervise those licensed 23 apprentices. 24 (g) No approved apprenticeship program may sponsor 25 more licensed apprentices with less than 2 years 26 experience than it has licensed plumbers available to 27 supervise those licensed apprentices. 28 (h) No individual shall work as an apprentice 29 plumber unless he or she is properly licensed under this 30 Act. The Department shall issue an apprentice plumber's 31 license to each approved applicant. 32 (i) No licensed apprentice plumber shall serve more 33 than a 6 year licensed apprenticeship period. If, upon 34 completion of a 6 year licensed apprenticeship period, -10- LRB9204189LBmg 1 such licensed apprentice plumber does not apply for the 2 examination for a plumber's license and successfully pass 3 the examination for a plumber's license, his or her 4 apprentice plumber's license shall not be renewed. 5 Nothing contained in P.A. 83-878, entitled "An Act in 6 relation to professions", approved September 26, 1983, was 7 intended by the General Assembly nor should it be construed 8 to require the employees of a governmental unit or privately 9 owned municipal water supplier who operate, maintain or 10 repair a water or sewer plant facility which is owned or 11 operated by such governmental unit or privately owned 12 municipal water supplier to be licensed plumbers under this 13 Act. In addition, nothing contained in P.A. 83-878 was 14 intended by the General Assembly nor should it be construed 15 to permit persons other than licensed plumbers to perform the 16 installation, repair, maintenance or replacement of plumbing 17 fixtures, such as toilet facilities, floor drains, showers 18 and lavatories, and the piping attendant to those fixtures, 19 within such facility or in the construction of a new 20 facility. 21 Nothing contained in P.A. 83-878, entitled "An Act in 22 relation to professions", approved September 26, 1983, was 23 intended by the General Assembly nor should it be construed 24 to require the employees of a governmental unit or privately 25 owned municipal water supplier who install, repair or 26 maintain water service lines from water mains in the street, 27 alley or curb line to private property lines and who install, 28 repair or maintain water meters to be licensed plumbers under 29 this Act if such work was customarily performed prior to the 30 effective date of such Act by employees of such governmental 31 unit or privately owned municipal water supplier who were not 32 licensed plumbers. Any such work which was customarily 33 performed prior to the effective date of such Act by persons 34 who were licensed plumbers or subcontracted to persons who -11- LRB9204189LBmg 1 were licensed plumbers must continue to be performed by 2 persons who are licensed plumbers or subcontracted to persons 3 who are licensed plumbers. When necessary under this Act, 4 the Department shall make the determination whether or not 5 persons who are licensed plumbers customarily performed such 6 work. 7 (Source: P.A. 91-91, eff. 1-1-00; 91-678, eff. 1-26-00.) 8 (225 ILCS 320/8) (from Ch. 111, par. 1107) 9 Sec. 8. The Director shall: 10 (1) Prepare forms for application for examination for a 11 plumber's license. 12 (2) Prepare and issue licenses as provided in this Act. 13 (3) With the aid of the Board prescribe rules and 14 regulations for examination of applicants for plumber's 15 licenses. 16 (4) With the aid of the Board prepare and give uniform 17 and comprehensive examinations to applicants for a plumber's 18 license which shall test their knowledge and qualifications 19 in the planning and design of plumbing systems, their 20 knowledge, qualifications, and manual skills in plumbing, and 21 their knowledge of the State's minimum code of standards 22 relating to fixtures, materials, design and installation 23 methods of plumbing systems, promulgated pursuant to this 24 Act. 25 (5) Issue a plumber's license and license renewal to 26 every applicant who has passed the examination and who has 27 paid the required license and renewal fee. 28 (6) Prescribe rules for hearings to deny, suspend, 29 revoke or reinstate licenses as provided in this Act. 30 (7) Maintain a current record showing (a) the names and 31 addresses of licensed plumbing contractors, licensed 32 plumbers, licensed apprentice plumbers, and licensed retired 33 plumbers, (b) the dates of issuance of licenses, (c) the date -12- LRB9204189LBmg 1 and substance of the charges set forth in any hearing for 2 denial, suspension or revocation of any license, (d) the date 3 and substance of the final order issued upon each such 4 hearing, and (e) the date and substance of all petitions for 5 reinstatement of license and final orders on such petitions. 6 (8) Prescribe, in consultation with the Board, uniform 7 and reasonable rules defining what constitutes an approved 8 course of instruction in plumbing, in colleges, universities, 9 or trade schools, and approve or disapprove the courses of 10 instruction offered by such colleges, universities, or trade 11 schools by reference to their compliance or noncompliance 12 with such rules. Such rules shall be designed to assure that 13 an approved course of instruction will adequately teach the 14 design, planning, installation, replacement, extension, 15 alteration and repair of plumbing. 16 (Source: P.A. 89-665, eff. 8-14-96.) 17 (225 ILCS 320/13.1 new) 18 Sec. 13.1. Plumbing contractors; license required; 19 applications. 20 (1) After May 1, 2002 all plumbing contractors doing 21 business in Illinois shall be licensed in accordance with the 22 provisions of this Act. 23 (2) Application for licensure shall be filed with the 24 Department each year, on or before the first day of May, in 25 writing on forms prepared and furnished by the Department. 26 All plumbing contractor licenses shall expire on the last day 27 of April of each year. 28 (3) Applications shall contain the name, address, and 29 telephone number of the person and the Illinois plumber's 30 license number of (i) the individual, if a sole 31 proprietorship; (ii) the partner, if a partnership; or, (iii) 32 an officer, if a corporation. The application shall contain 33 the business name and address, evidence of financial -13- LRB9204189LBmg 1 responsibility, and any other information as the Department 2 may by rule require. 3 (4) Applicants shall submit to the Department a 4 certificate documenting that the contractor carries liability 5 insurance, self insurance, group insurance, group self 6 insurance, a letter of credit, or a bond in an amount of at 7 least $20,000 for work performed in accordance with this Act 8 and the rules promulgated under this Act. No contractor may 9 be licensed in the absence of a certificate. Certificates 10 must be in force at all times during licensure. 11 (5) At least one owner or officer of every licensed 12 plumbing contractor shall be licensed as a plumber in 13 accordance with this Act. All employees of a licensed 14 plumbing contractor who engage in plumbing work shall be 15 licensed as plumbers or apprentice plumbers in accordance 16 with this Act. 17 (6) Licensed plumbing contractors shall submit an annual 18 licensure fee in an amount to be established by rule. 19 (7) Plumbing contractor licenses shall be renewed 20 annually upon the submission of the licensure fee and proof 21 of the $20,000 performance indemnification, which must occur 22 30 days prior to expiration of the current license. 23 (8) The Department shall be notified in advance of any 24 changes in the business structure, name, or location, or in 25 the addition or deletion of the owner or officer who is the 26 licensed plumber listed in the application. Failure to notify 27 the Department of this information is grounds for suspension 28 or revocation of the plumbing contractor's license. 29 (225 ILCS 320/14) (from Ch. 111, par. 1113) 30 Sec. 14. License renewal; continuing education. All 31 plumbing contractor's licenses, plumber's licenses, and 32 apprentice plumber's licenses issued under this Act shall 33 expire on April 30 next following date of issuance. The term -14- LRB9204189LBmg 1 for retired plumber's licenses shall be prescribed by 2 Department rule after consultation with the Board of Plumbing 3 Examiners. 4 An apprentice plumber's license shall also expire the 5 date that the licensed plumber sponsor of such licensed 6 apprentice plumber severs his or her sponsor status with the 7 licensed apprentice plumber. The licensed plumber sponsor 8 shall immediately notify the Department of the severance of 9 his or her relationship with the licensed apprentice plumber. 10 Such apprentice plumber may, on forms provided by the 11 Department, apply for reinstatement of his or her apprentice 12 license by submitting to the Department a new application and 13 new apprentice plumber's license fee. The application shall 14 verify that the applicant for reinstatement of his or her 15 apprentice plumber's license is sponsored by an Illinois 16 licensed plumber. If the applicant is employed by a firm, 17 the application shall contain the name and license number of 18 an Illinois licensed plumber employee of the firm or name and 19 license number of an Illinois licensed plumber member of the 20 firm, or name and Illinois plumber's license number of an 21 officer of a corporation who is the sponsor. Licensed 22 apprentice plumbers shall not accumulate more than 6 years as 23 a licensed apprentice plumber. 24 Upon the recommendation of the Board, the Department may 25 require by rule that each licensed plumber annually complete 26 a minimum number of hours of classroom instruction and 27 provide evidence of attending the classes before receiving a 28 renewal plumber license. A continuing education requirement 29 established by the Department for all licensed plumbers shall 30 not exceed 15 hours per year. In addition, the Department 31 shall by rule establish guidelines for additional continuing 32 education to be required for licensed plumbers found to have 33 committed repeated Plumbing Code violations. In support of 34 these requirements, the Department shall by rule establish -15- LRB9204189LBmg 1 curricula for continuing education and requirements for 2 instructors and may certify instructors and training programs 3 and schools for continuing education. 4 A plumber's license and an apprentice plumber's license 5 may be renewed for a period of one year from each succeeding 6 May 1st upon payment prior to May 1st of the required renewal 7 fee and submission of required evidence of successful 8 completion of any required continuing education courses. 9 Application for renewal shall be on forms provided by the 10 Department. An application for renewal of licenses received 11 by the Department after May 1st shall include the annual 12 renewal fees plus reinstatement fees, provided that the 13 apprentice plumber's application is received by November 1 of 14 the same year. 15 A plumber licensed pursuant to this Act whose license has 16 been expired for a period of less than 5 years may apply to 17 the Department for reinstatement of his or her plumber's 18 license. The Department shall issue such license renewal 19 provided the applicant pays to the Department all lapsed 20 renewal fees, plus the reinstatement fee. A plumber 21 licensed pursuant to this Act who has permitted his or her 22 license to expire for more than 5 years may apply, in 23 writing, to the Department for restoration of his or her 24 license. The Department shall restore his or her license 25 provided he or she pays to the Department the required 26 restoration fee and shall successfully pass the examination 27 for an Illinois plumber's license. The restoration fee 28 includes the applicant's examination fee. Failure by the 29 applicant to successfully pass the plumber's license 30 examination shall be sufficient grounds for the Department to 31 withhold issuance of the requested restoration of the 32 applicant's plumber's license. The applicant may retake the 33 examination in accordance with the provisions of this Act. 34 A retired plumber licensed under this Act who has -16- LRB9204189LBmg 1 surrendered his or her plumber's license for a period of less 2 than 5 years may apply to the Department for reinstatement of 3 his or her plumber's license. The Department shall renew the 4 license provided the applicant pays to the Department any 5 reinstatement fee required by Department rule. A retired 6 plumber licensed under this Act who has surrendered his or 7 her plumber's license for a period of more than 5 years may 8 apply in writing to the Department for restoration of his or 9 her license. The Department shall restore his or her license 10 provided he or she pays to the Department the restoration fee 11 required by Department rule and successfully passes the 12 examination for an Illinois plumber's license. The 13 restoration fee includes the applicant's examination fee. 14 Failure by the applicant to successfully pass the plumber's 15 license examination shall be sufficient grounds for the 16 Department to withhold issuance of the requested restoration 17 of the applicant's plumber's license. Grounds for discipline. (1) The Director may 23 deny, revoke or suspend a license when findings show one or 24 more of the following: 25 (a) That the licensee obtained or conspired with 26 others to obtain a license by inducing the issuance 27 thereof in consideration of the payment of money or 28 delivery of any other thing of value or by and through 29 misrepresentation of facts. 30 (b) That the licensee willfully violated any law of 31 this State or any rule, regulation or code promulgated 32 thereunder regulating plumbing, licensed plumbing 33 contractors, licensed plumbers, licensed apprentice -17- LRB9204189LBmg 1 plumbers, licensed retired plumbers, water well pump 2 installations and private sewage disposal systems. 3 (c) That the licensee has been guilty of negligence 4 or incompetence in the performance of plumbing. 5 (d) That the licensee has loaned or in any manner 6 transferred his or her license to another person. 7 (e) That the sponsor or his or her agent has failed 8 to properly supervise a licensed apprentice plumber. 9 (2) If a license is suspended or revoked, the license 10 shall be surrendered to the Department but, if suspended, it 11 shall be returned to the licensee upon the termination of the 12 suspension period. 13 The Department may refuse to issue or may suspend the 14 license of any person who fails to file a return, or to pay 15 the tax, penalty or interest shown in a filed return, or to 16 pay any final assessment of tax, penalty or interest, as 17 required by any tax Act administered by the Illinois 18 Department of Revenue, until such time as the requirements of 19 any such tax Act are satisfied. 20 (Source: P.A. 87-885.) 21 Section 99.
