Amend House Bill 1975 as follows: 3 on page 2, by replacing lines 1 and 2 with the following: 4 "which the taxes are imposed until the taxes are paid or 5 until a court order transfers ownership of the mobile home."; 6 and 7 on page 2, by replacing line 7 with the following: 8 "forfeited to the State and there is not an open scavenger 9 buy. The mobile home may be sold under"; and 10 on page 4, by replacing line 27 with the following: 11 "the mobile home dangerous or hazardous, when the mobile home 12 is in violation of mobile home park rules and regulations, 13 when taxes on the"; and 14 on page 5, by replacing line 27 with the following: 15 "title to the mobile home and upon acquisition of the 16 certificate of title may manage and operate the"; and 17 on page 6, by replacing line 4 with the following: 18 "notice. The notice shall list the street or common address, 19 and the mobile home park where the mobile home is sited,"; 20 and 21 on page 9, by replacing line 1 with the following: -2- LRB9201948AGmbam01 1 "owners, and the street, common address, and mobile home park 2 where the mobile home is sited, if known, the vehicle 3 identification number, the"; and 4 on page 13, by replacing line 28 with the following: 5 "The record shall set forth the name of the owner and the 6 street, common address, and mobile home park where the mobile 7 home is sited, if"; and 8 by replacing line 26 on page 20 through line 17 on page 21 9 with the following: 10 "inhabitants, only the published taxes, interest, and costs 11 as advertised in the sale shall be required to be paid 12 forthwith. The purchaser"; and 13 on page 34, by replacing line 27 with the following: 14 "Local Services Tax Act. Mobile home park owners are not 15 deemed to have an ownership interest as defined in this 16 Section."; and 17 on page 57, by replacing lines 17 and 18 with the following: 18 "provided in Sections 375 and 380 by a special process 19 server."; and 20 on page 59, by replacing line 12 with the following: 21 "If the mobile home sold is abandoned or if any mobile 22 home park owner,"; and 23 on page 64, by replacing line 28 with the following: 24 "Section 380. In addition, the notice shall be served by a 25 process server or"; and 26 by replacing line 33 on page 64 through line 4 on page 65 27 with the following: 28 "In counties of 3,000,000 or more inhabitants where the 29 petitioner is a petitioner for tax certificate of title 30 pursuant to Section 35, in lieu of service by the sheriff or 31 coroner, the notice may be served by a process server."; and -3- LRB9201948AGmbam01 1 on page 72, by replacing lines 6 through 16 with the 2 following: 3 "Section 402. Mobile homes located in manufactured home 4 community; requirements. The person who has a certificate of 5 purchase and obtains a court order directing the issuance of 6 a tax certificate of title under Section 400 for a mobile 7 home located on a lot in a manufactured home community is 8 liable for lot rent (at the prevailing rate) beginning on the 9 date of the entry of the court order and shall either (i) 10 qualify for tenancy in the manufactured home community in 11 accordance with the community's normal tenant qualification 12 and screening procedures or (ii) remove the mobile home from 13 the lot no later than 30 days after the date of the entry of 14 the court order."; and 15 on page 79, line 7, by replacing "2002" with "2003"; and 16 on page 79, line 10, by replacing "2002" with "2003"; and 17 on page 79, by replacing line 15 with the following: 18 "the tax bill to the address of record. The first tax bill 19 mailed for taxable year 2003 shall include the following 20 notice: "The manner in which delinquent taxes on mobile homes 21 are collected has been changed by the enactment of the Mobile 22 Home Local Services Tax Enforcement Act. Failure to pay this 23 tax can result in a penalty of $25 per month." The county 24 treasurer"; and 25 on page 81, line 5, by replacing "2002" with "2003"; and 26 on page 81, line 10, by replacing "2002" with "2003"; and 27 on page 81, by replacing line 13 with the following: 28 "shall be required to pay a penalty of $25 per month, or any 29 portion thereof, not to exceed $100. If such failure"; and 30 on page 105, line 2, by replacing "2002" with "2003".
