92_HB1640enr HB1640 Enrolled LRB9203431TApc 1 AN ACT in relation to State government. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Budget Law of the Civil 5 Administrative Code of Illinois is amended by changing 6 Section 50-15 as follows: 7 (15 ILCS 20/50-15) (was 15 ILCS 20/38.2) 8 Sec. 50-15. Department accountability reports; Budget9Advisory Panel. 10 (a) Beginning in the fiscal year which begins July 1, 11 1992, each department of State government as listed in 12 Section 5-15 of the Departments of State Government Law (20 13 ILCS 5/5-15) shall submit an annual accountability report to 14 the Bureau of the Budget at times designated by the Director 15 of the Bureau of the Budget. Each accountability report shall 16 be designed to assist the Bureau of the Budget in its duties 17 under Sections 2.2 and 2.3 of the Bureau of the Budget Act 18 and shall measure the department's performance based on 19 criteria, goals, and objectives established by the department 20 with the oversight and assistance of the Bureau of the 21 Budget. Each department shall also submit interim progress 22 reports at times designated by the Director of the Bureau of 23 the Budget. 24 (b) (Blank).There is created a Budget Advisory Panel,25consisting of 10 representatives of private business and26industry appointed 2 each by the Governor, the President of27the Senate, the Minority Leader of the Senate, the Speaker of28the House of Representatives, and the Minority Leader of the29House of Representatives. The Budget Advisory Panel shall30aid the Bureau of the Budget in the establishment of the31criteria, goals, and objectives by the departments for use inHB1640 Enrolled -2- LRB9203431TApc 1measuring their performance in accountability reports. The2Budget Advisory Panel shall also assist the Bureau of the3Budget in reviewing accountability reports and assessing the4effectiveness of each department's performance measures. The5Budget Advisory Panel shall submit to the Bureau of the6Budget a report of its activities and recommendations for7change in the procedures established in subsection (a) at the8time designated by the Director of the Bureau of the Budget,9but in any case no later than the third Friday of each10November.11 (c) The Director of the Bureau of the Budget shall 12 select not more than 3 departments for a pilot program 13 implementing the procedures of subsection (a) for budget 14 requests for the fiscal years beginning July 1, 1990 and July 15 1, 1991, and each of the departments elected shall submit 16 accountability reports for those fiscal years. 17 By April 1, 1991, the Bureau of the Budgetwith the18assistance of the Budget Advisory Panelshall recommend in 19 writing to the Governor any changes in the budget review 20 process established pursuant to this Section suggested by its 21 evaluation of the pilot program. The Governor shall submit 22 changes to the budget review process that the Governor plans 23 to adopt, based on the report, to the President and Minority 24 Leader of the Senate and the Speaker and Minority Leader of 25 the House of Representatives. 26 (Source: P.A. 91-239, eff. 1-1-00.) 27 (20 ILCS 230/15 rep.) 28 (20 ILCS 230/20 rep.) 29 Section 10. The Biotechnology Sector Development Act is 30 amended by repealing Sections 15 and 20. 31 (20 ILCS 605/605-450 rep.) 32 Section 15. The Department of Commerce and Community HB1640 Enrolled -3- LRB9203431TApc 1 Affairs Law of the Civil Administrative Code of Illinois is 2 amended by repealing Section 605-450. 3 (20 ILCS 670/Act rep.) 4 Section 20. The Military Base Reuse Advisory Board Act 5 is repealed. 6 Section 25. The State Officers and Employees Money 7 Disposition Act is amended by changing Section 1 as follows: 8 (30 ILCS 230/1) (from Ch. 127, par. 170) 9 Sec. 1. Application of Act; exemptions. The officers of 10 the Executive Department of the State Government, the Clerk 11 of the Supreme Court, the Clerks of the Appellate Courts, the 12 Departments of the State government created by the Civil 13 Administrative Code of Illinois, and all other officers, 14 boards, commissions, commissioners, departments, 15 institutions, arms or agencies, or agents of the Executive 16 Department of the State government except the University of 17 Illinois, Southern Illinois University, Chicago State 18 University, Eastern Illinois University, Governors State 19 University, Illinois State University, Northeastern Illinois 20 University, Northern Illinois University, Western Illinois 21 University, the Cooperative Computer Center, and the Board of 22 Trustees of the Illinois Bank Examiners' Education Foundation 23 for moneys collected pursuant to subsection (11) of Section 24 48 of the Illinois Banking Act for purposes of the Illinois 25 Bank Examiners' Education Program are subject to this Act. 26 This Act shall not apply, however, to any of the following: 27 (i) the receipt by any such officer of federal funds made 28 available under such conditions as precluded the payment 29 thereof into the State Treasury, (ii) (blank)income derived30from the operation of State parks which is required to be31deposited in the State Parks Revenue Bond Fund pursuant toHB1640 Enrolled -4- LRB9203431TApc 1the State Parks Revenue Bond Act, (iii) the Director of 2 Insurance in his capacity as rehabilitator or liquidator 3 under Article XIII of the Illinois Insurance Code, (iv) funds 4 received by the Illinois State Scholarship Commission from 5 private firms employed by the State to collect delinquent 6 amounts due and owing from a borrower on any loans guaranteed 7 by such Commission under the Higher Education Student 8 Assistance Law or on any "eligible loans" as that term is 9 defined under the Education Loan Purchase Program Law, or (v) 10 moneys collected on behalf of lessees of facilities of the 11 Department of Agriculture located on the Illinois State 12 Fairgrounds at Springfield and DuQuoin. This Section 1 shall 13 not apply to the receipt of funds required to be deposited in 14 the Industrial Project Fund pursuant to Section 12 of the 15 Disabled Persons Rehabilitation Act. 16 (Source: P.A. 88-571, eff. 8-11-94; 89-4, eff. 1-1-96.) 17 (20 ILCS 805/805-310 rep.) 18 Section 30. The Department of Natural Resources 19 (Conservation) Law of the Civil Administrative Code of 20 Illinois is amended by repealing Section 805-310. 21 (30 ILCS 380/Act rep.) 22 Section 35. The State Parks Revenue Bond Act is 23 repealed. 24 (30 ILCS 150/8 rep.) 25 Section 40. The Natural Heritage Fund Act is amended by 26 repealing Section 8. 27 (70 ILCS 200/Art. 135 rep.) 28 Section 45. The Civic Center Code is amended by 29 repealing Article 135. HB1640 Enrolled -5- LRB9203431TApc 1 (605 ILCS 10/3.1 rep.) 2 Section 55. The Toll Highway Act is amended by repealing 3 Section 3.1. 4 (730 ILCS 5/3-6-3.1 rep.) 5 Section 60. The Unified Code of Corrections is amended 6 by repealing Section 3-6-3.1. 7 Section 999. Effective date. This Act takes effect upon 8 becoming law.
