92_HB1508 LRB9202109DHtm 1 AN ACT regarding vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Section 3-100 as follows: 6 (625 ILCS 5/3-100) (from Ch. 95 1/2, par. 3-100) 7 Sec. 3-100. Definitions. As used inFor the purposes of8 this Chapter, the following words shall have the meanings 9 ascribed to them: 10 "Electronic" includes electrical, digital, magnetic, 11 optical, electromagnetic, or any other form of technology 12 that entails capabilities similar to these technologies. 13 "Electronic record" means a record generated, 14 communicated, received, or stored by electronic means for use 15 in an information system or for transmission from one 16 information system to another. 17 "Electronic signature" means a signature in electronic 18 form attached to or logically associated with an electronic 19 record. 20 "Owner" means a person who holds legal document of 21 ownership of a vehicle, limited to a certificate of origin, 22 certificate of title, salvage certificate, or junking 23 certificate. However, in the event a vehicle is the subject 24 of an agreement for the conditional sale or lease thereof 25 with the right of purchase upon performance of the conditions 26 stated in the agreement and with an immediate right of 27 possession vested in the conditional vendee or lessee, or in 28 the event a mortgagor of such vehicle is entitled to 29 possession, then such conditional vendee or lessee or 30 mortgagor shall be deemed the owner for the purpose of this 31 Chapter, except as provided under paragraph (c) of Section -2- LRB9202109DHtm 1 3-118. 2 "Record" means information that is inscribed, stored, or 3 otherwise fixed on a tangible medium or that is stored in an 4 electronic or other medium and is retrievable in perceivable 5 form. 6 "Signature" or "signed" includes any symbol executed or 7 adopted, or any security procedure employed or adopted, using 8 electronic means or otherwise, by or on behalf of a person 9 with intent to authenticate a record. 10 (Source: P.A. 91-79, eff. 1-1-00; 91-357, eff. 7-29-99; 11 91-772, eff. 1-1-01.)
