92_HB1014 LRB9207272RCcd 1 AN ACT in relation to criminal law. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Code of 1961 is amended by 5 adding Section 12-21.7 as follows: 6 (720 ILCS 5/12-21.7 new) 7 Sec. 12-21.7. Aggravated endangerment of the life or 8 health of a child. 9 (a) A person commits the offense of aggravated 10 endangerment of the life or health of a child when he or she 11 commits an offense under Section 12-21.6, and any of the 12 following factors were present at the time of the commission 13 of the offense: 14 (1) the child was under the age of 12; 15 (2) the offense constituted an immediate threat to 16 the life of the child; or 17 (3) the offense was committed in conjunction with 18 the commission of another offense. 19 (b) Sentence. A violation of this Section is a Class 4 20 felony. A second or subsequent violation of this Section is 21 a Class 2 felony.
