1 AN ACT concerning family law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 2. The Illinois Marriage and Dissolution of
5 Marriage Act is amended by changing Section 516 as follows:
6 (750 ILCS 5/516) (from Ch. 40, par. 516)
7 Sec. 516. Public Aid collection fee. In all cases
8 instituted by the Illinois Department of Public Aid on behalf
9 of a child or spouse, other than one receiving a grant of
10 financial aid under Article IV of The Illinois Public Aid
11 Code, on whose behalf an application has been made and
12 approved for support services as provided by Section 10-1 of
13 that Code, the court shall impose a collection fee on the
14 individual who owes a child or spouse support obligation in
15 an amount equal to 10% of the amount so owed as long as such
16 collection is required by federal law, which fee shall be in
17 addition to the support obligation. The imposition of the
18 such fee shall be in accordance with provisions of Title IV,
19 Part D, of the Social Security Act and regulations duly
20 promulgated thereunder. The fee shall be payable to the
21 clerk of the circuit court for transmittal to the Illinois
22 Department of Public Aid and shall continue until support
23 services are terminated by that Department.
