92_HB0781 LRB9206364DJmg 1 AN ACT in relation to business transactions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Consumer Fraud and Deceptive Business 5 Practices Act is amended by changing Section 2 as follows: 6 (815 ILCS 505/2) (from Ch. 121 1/2, par. 262) 7 Sec. 2. Unlawful practice; federal law. Unfair methods 8 of competition and unfair or deceptive acts or practices, 9 including but not limited to the use or employment of any 10 deception, fraud, false pretense, false promise, or 11 misrepresentation, or the concealment, suppression, or 12 omission of any material fact, with intent that others rely 13 upon the concealment, suppression, or omission of such 14 material fact, or the use or employment of any practice 15 described in Section 2 of the"Uniform Deceptive Trade 16 Practices Act", approved August 5, 1965, in the conduct of 17 any trade or commerce are hereby declared unlawful whether 18 any person has in fact been misled, deceived, or damaged 19 thereby. In construing this Section, consideration shall be 20 given to the interpretations of the Federal Trade Commission 21 and the federal courts relating to Section 5 (a) of the 22 Federal Trade Commission Act. 23 (Source: P.A. 78-904.)
