92_HB0530 LRB9205283LDpr 1 AN ACT in relation to gambling. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Charitable Games Act is amended by 5 changing Section 2 as follows: 6 (230 ILCS 30/2) (from Ch. 120, par. 1122) 7 Sec. 2. Definitions. For purposes of this Act, the 8 following definitions apply: 9 "Organization": A corporation, agency, partnership, 10 institution, association, firm or other entity consisting of 11 2 or more persons joined by a common interest or purpose. 12 "Sponsoring organization": A qualified organization that 13 has obtained a license to conduct a charitable games event in 14 conformance withthe provisions ofthis Act. 15 "Qualified organization": 16 (a) a charitable, religious, fraternal, veterans, 17 labor or educational organization or institution 18 organized and conducted on a not-for-profit basis with no 19 personal profit inuring to anyone as a result of the 20 operation and which is exempt from federal income 21 taxation under Sections 501(c)(3), 501(c)(4), 501(c)(5), 22 501(c)(8), 501(c)(10) or 501(c)(19) of the Internal 23 Revenue Code; 24 (b) a veterans organization as defined in Section 1 25 of the"Bingo License and Tax Act", approved July 22,261971, as amended,organized and conducted on a 27 not-for-profit basis with no personal profit inuring to 28 anyone as a result of the operation; or 29 (c) An auxiliary organization of a veterans 30 organization. 31 "Fraternal organization": A civic, service or charitable -2- LRB9205283LDpr 1 organization in this State except a college or high school 2 fraternity or sorority, not for pecuniary profit, which is a 3 branch, lodge or chapter of a national or State organization 4 and exists for the common business, brotherhood, or other 5 interest of its members. 6 "Veterans organization": An organization comprised of 7 members of which substantially all are individuals who are 8 veterans or spouses, widows, or widowers of veterans, the 9 primary purpose of which is to promote the welfare of its 10 members and to provide assistance to the general public in 11 such a way as to confer a public benefit. 12 "Labor organization": An organization composed of labor 13 unions or workers organized with the objective of betterment 14 of the conditions of those engaged in such pursuit and the 15 development of a higher degree of efficiency in their 16 respective occupations. 17 "Department": The Department of Revenue. 18 "Volunteer": A person recruited by the sponsoring 19 organization who voluntarily performs services at a 20 charitable games event, including participation in the 21 management or operation of a game, as defined in Section 8. 22 "Person": Any natural individual, a corporation, a 23 partnership, a limited liability company, an organization as 24 defined in this Section, a qualified organization, a 25 sponsoring organization, any other licensee under this Act, 26 or a volunteer. 27 (Source: P.A. 87-758; 88-669, eff. 11-29-94.)
