92_HB0298 LRB9203115TAtm 1 AN ACT concerning humane care for animals. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Humane Care for Animals Act is amended by 5 adding Section 2.09 and by changing Sections 4.03 and 4.04 as 6 follows: 7 (510 ILCS 70/2.09 new) 8 Sec. 2.09. Search and rescue dog. "Search and rescue dog" 9 means a dog that is trained to locate lost or missing 10 persons, victims of natural or man-made disasters, and human 11 bodies. 12 (510 ILCS 70/4.03) (from Ch. 8, par. 704.03) 13 Sec. 4.03. Teasing, striking or tampering with police 14 animals or search and rescue dogs prohibited. 15 (a) It shall be unlawful for any person to willfully and 16 maliciously taunt, torment, tease, beat, strike, or 17 administer or subject any desensitizing drugs, chemicals or 18 substance to any animal used by a law enforcement officer in 19 the performance of his functions or duties, or when placed in 20 confinement off duty; or to interfere or meddle with any such 21 animal used by a law enforcement department or agency or any 22 handler thereof in the performance of the functions or duties 23 of the department or agency. 24 (b) It is unlawful for any person to willfully and 25 maliciously taunt, torment, tease, beat, strike, or 26 administer or subject any desensitizing drugs, chemicals, or 27 substance to a search and rescue dog, or to interfere or 28 meddle with a search and rescue dog or the dog's handler. 29 (Source: P.A. 90-80, eff. 7-10-97.) -2- LRB9203115TAtm 1 (510 ILCS 70/4.04) (from Ch. 8, par. 704.04) 2 Sec. 4.04. Injuring or killing police animals or search 3 and rescue dogs prohibited. 4 (a) It shall be unlawful for any person to willfully or 5 maliciously torture mutilate, injure, disable, poison, or 6 kill any animal used by a law enforcement department or 7 agency in the performance of the functions or duties of the 8 department or agency or when placed in confinement off duty. 9 However, a police officer or veterinarian may perform 10 euthanasia in emergency situations when delay would cause the 11 animal undue suffering and pain. 12 (b) It is unlawful for any person to willfully or 13 maliciously torture, mutilate, injure, disable, poison, or 14 kill a search and rescue dog; however, a peace officer, a 15 veterinarian, or a dog's owner may perform euthanasia. 16 (Source: P.A. 90-80, eff. 7-10-97; 91-357, eff. 7-29-99.)
