Amend House Bill 246, on page 8, 3 line 32, after "collect" by inserting "from the reports 4 required in subsection (A) of Section 23"; and 5 on page 9, by replacing lines 4 and 5 with "felonies within 6 the most recent 10 years. For"; and 7 on page 9, by deleting lines 10 through 13; and 8 on page 9, line 14, by replacing "(3)" with "(2)"; and 9 on page 9, line 16, after the period, by inserting "All final 10 disciplinary actions shall remain a matter of public 11 record."; and 12 on page 9, line 17, by replacing "(4)" with "(3)"; and 13 on page 9, line 19, after "years", by inserting ", but in no 14 event earlier than the year 1995. This information shall 15 come from the Federation of State Medical Boards or other 16 national reporting agencies. Information that is 17 confidential in the reporting state shall not be included in 18 the profile:"; and 19 on page 9, line 20, by replacing "(5)" with "(4)"; and 20 on page 9, by replacing lines 21 through 29 with "restriction -2- LRB9201405LBpcam 1 of hospital privileges as required in subsection (A)(1) of 2 Section 23. Only cases that have occurred within the"; and 3 on page 9, by replacing lines 32 through 34 with the 4 following: 5 "(6) All medical malpractice court judgments, and 6 medical malpractice arbitration awards in which a payment 7 is made to a complaining party, within the most recent 10 8 years, but in no event earlier than the year 1995. 9 Dispositions of paid claims shall be reported in a 10 minimum of 3 graduated categories indicating the level of 11 significance of the award. Information concerning paid 12 medical malpractice claims shall be put in context by 13 comparing an individual licensee's medical malpractice 14 judgment and arbitration awards to the experience of 15 other licensees within the same specialty. Nothing in 16 this Section shall be construed to limit or prevent the 17 Disciplinary Board from providing further explanatory 18 information regarding the significance of categories in 19 which payments are reported."; and 20 on page 10, by deleting lines 1 through 20; and 21 on page 10, line 26, by replacing "(7)"with "(6)"; and 22 on page 12, by deleting lines 8 through 11; and 23 on page 12, line 6, by replacing "(6)" with "(5)"; and 24 on page 12, line 21, by replacing "(7)" with "(6)"; and 25 on page 12, line 25, by replacing "(8)" with "(7)"; and 26 on page 12, line 28, by replacing "(9)" with "(8)"; and 27 on page 12, line 32, by replacing "(10)" with "(9)"; and 28 on page 13, line 1, by replacing "(11)" with "(10)"; and 29 on page 13, after line 5, by inserting the following: -3- LRB9201405LBpcam 1 "(d) The funding for the implementation of the physician 2 profiling shall not come from the Medical Disciplinary 3 Fund.".
