92_HB0124 LRB9201151SMdv 1 AN ACT to amend the Election Code by changing Section 2 9-9.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by changing 6 Section 9-9.5 as follows: 7 (10 ILCS 5/9-9.5) 8 Sec. 9-9.5. Disclosure on political literature and in 9 political phone calls. 10 (a) Any pamphlet, circular, handbill, advertisement, or 11 other political literature that supports or opposes any 12 public official, candidate for public office, or question of 13 public policy, or that would have the effect of supporting or 14 opposing any public official, candidate for public office, or 15 question of public policy, shall contain the name of the 16 individual or organization that authorized, caused to be 17 authorized, paid for, caused to be paid for, or distributed 18 the pamphlet, circular, handbill, advertisement, or other 19 political literature. If the individual or organization 20 includes an address, it must be an actual personal or 21 business address of the individual or business address of the 22 organization. 23 This subsection (a)Sectiondoes not apply to items, the 24 size of which is not sufficient to contain the required 25 disclosure. 26 (b) At the beginning of any phone call that supports or 27 opposes any public official, candidate for public office, or 28 question of public policy, or that would have the effect of 29 supporting or opposing any public official, candidate for 30 public office, or question of public policy, the caller or 31 recorded message must state the name of the individual or -2- LRB9201151SMdv 1 organization that authorized, caused to be authorized, paid 2 for, or caused to be paid for the phone call. If the 3 individual or organization includes an address, it must be an 4 actual personal or business address of the individual or 5 business address of the organization. 6 (Source: P.A. 90-737, eff. 1-1-99.) 7 Section 99. Effective date. This Act takes effect upon 8 becoming law.
