92_HB0094 LRB9200889JSpc 1 AN ACT to amend the Illinois Insurance Code by changing 2 Section 143.10b. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Insurance Code is amended by 6 changing Section 143.10b as follows: 7 (215 ILCS 5/143.10b) (from Ch. 73, par. 755.10b) 8 Sec. 143.10b. Loss information;,private passenger 9 automobile. 10 (1) A companyAll companiesissuing a "policy of 11 automobile insurance" as defined in paragraph (a) of Section 12 143.13 of this Code shall, on or after January 1, 1990, 13 provide the following loss information for the 5 previous 14 policy years to the named insured within 30 days of the 15 insured's written request: 16 (a) on closed claims, date and description of 17 occurrence, and total amount of payments; 18 (b) on open claims, date and description of 19 occurrence and total amount of payments; 20 (c) for any occurrence not included in (a) or (b) 21 of this subsection, the date and description of 22 occurrence. 23 (2) If a company fails to provide the information as 24 required by this Section with such frequency so as to 25 indicate a practice of refusing to provide such information, 26 such failure shall constitute an unfair trade practice as 27 defined in Section 424 and subject to those hearing and 28 penalty provisions as set forth in Sections 425 through 434 29 of this Code. 30 (Source: P.A. 90-196, eff. 1-1-98.)
