92_HB0060eng HB0060 Engrossed LRB9200680TAcs 1 AN ACT concerning carnivals. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Municipal Code is amended by 5 changing Section 11-54.1-2 as follows: 6 (65 ILCS 5/11-54.1-2) (from Ch. 24, par. 11-54.1-2) 7 Sec. 11-54.1-2. No carnival shall be set up, run, 8 operated or conducted within the limits of a city, village or 9 incorporated town unless a written permit from the corporate 10 authorities has been issued, setting forth the conditions 11 under which such carnival shall be operated. An application 12 for a written permit to set up, run, operate, or conduct a 13 carnival in accordance with this Section shall include 14 without limitation the name, date of birth, and social 15 security number of the applicant and each employee or 16 subcontractor that the applicant, at the time of the 17 application, expects to be on site for the carnival. This 18 requirement does not apply to any person or contractor who 19 has not worked for the carnival an average of at least 20 20 hours or more per week during the 60 days immediately 21 preceding the first day the carnival is open to the public or 22 to any person or contractor that is a resident of the city, 23 village, or town in which the carnival is set up and 24 operating. The corporate authorities shall provide a copy of 25 the permit application to the local law enforcement agency 26 which, upon request, shall provide a copy to the Illinois 27 Department of Labor. The permit shall be granted upon the 28 condition that the requirements of this Section have been 29 complied with and upon the condition that there shall not be 30 set up or operated any gambling device, lottery, number or 31 paddle wheel, number board, punch board, or other game of HB0060 Engrossed -2- LRB9200680TAcs 1 chance, or any lewd, lascivious or indecent show or 2 attraction making an indecent exposure of the person or 3 suggesting lewdness or immorality. 4 (Source: Laws 1963, p. 860.) 5 Section 10. The Carnival Regulation Act is amended by 6 changing Section 2 as follows: 7 (225 ILCS 205/2) (from Ch. 85, par. 2002) 8 Sec. 2. No carnival shall be set up, run, operated or 9 conducted except within the limits of an incorporated 10 municipality, as provided in Division 54.1 of Article 11 of 11 the "Illinois Municipal Code", approved May 29, 1961, as 12 heretofore and hereafter amended, or within the limits or 13 upon the grounds of a State or county fair association, or 14 any association entitled to share in the funds appropriated 15 by the State for distribution among fair associations of the 16 State, and unless a written permit from the proper fair board 17 has been issued, setting forth the conditions under which 18 such carnival shall be operated. An application for a written 19 permit to set up, run, operate, or conduct a carnival in 20 accordance with this Section shall include without limitation 21 the name, date of birth, and social security number of the 22 applicant and each employee or subcontractor that the 23 applicant, at the time of the application, expects to be on 24 site for the carnival. This requirement does not apply to any 25 person or contractor who has not worked for the carnival an 26 average of at least 20 hours or more per week during the 60 27 days immediately preceding the first day the carnival is open 28 to the public or to any person or contractor that is a 29 resident of the city, village, or town in which the carnival 30 is set up and operating.
