Amend House Bill 48 by replacing the 3 title with the following: 4 "AN ACT concerning insurance."; and 5 by replacing everything after the enacting clause with the 6 following: 7 "Section 5. The Illinois Insurance Code is amended by 8 adding Section 356z.1 as follows: 9 (215 ILCS 5/356z.1 new) 10 Sec. 356z.1. Surgical assistants. A group or individual 11 policy of accident and health insurance amended, delivered, 12 issued, or renewed after the effective date of this 13 amendatory Act of the 92nd General Assembly that provides 14 coverage for health care services, including surgical 15 services, must provide coverage for services rendered by an 16 assistant in surgery authorized or credentialed by a hospital 17 or ambulatory surgical treatment center to provide surgical 18 assistance to a physician licensed to practice medicine in 19 all its branches. An assistant in surgery may be a physician 20 licensed to practice medicine in all its branches, a 21 physician assistant, an advanced practice registered nurse, a -2- LRB9200793JScsam 1 registered professional nurse, or a nationally certified 2 surgical assistant or nationally certified first assistant. 3 Section 10. The Health Maintenance Organization Act is 4 amended by changing Section 4-6.5 as follows: 5 (215 ILCS 125/4-6.5) 6 Sec. 4-6.5. Required health benefits. A health 7 maintenance organization is subject to the provisions of 8 Sections 356t,and356u, and 356z.1 of the Illinois Insurance 9 Code. 10 (Source: P.A. 90-7, eff. 6-10-97.) 11 Section 15. The Voluntary Health Services Plans Act is 12 amended by changing Section 10 as follows: 13 (215 ILCS 165/10) (from Ch. 32, par. 604) 14 Sec. 10. Application of Insurance Code provisions. 15 Health services plan corporations and all persons interested 16 therein or dealing therewith shall be subject to the 17 provisions of Articles IIA and XII 1/2 and Sections 3.1, 133, 18 140, 143, 143c, 149, 354, 355.2, 356r, 356t, 356u, 356v, 19 356w, 356x, 356y, 356z.1, 367.2, 368a, 401, 401.1, 402, 403, 20 403A, 408, 408.2, and 412, and paragraphs (7) and (15) of 21 Section 367 of the Illinois Insurance Code. 22 (Source: P.A. 90-7, eff. 6-10-97; 90-25, eff. 1-1-98; 90-655, 23 eff. 7-30-98; 90-741, eff. 1-1-99; 91-406, eff. 1-1-00; 24 91-549, eff. 8-14-99; 91-605, eff. 12-14-99; 91-788, eff. 25 6-9-00.) 26 Section 99.
