House Sponsors: KOSEL-LINDNER-COULSON-O'CONNOR-GASH Short description: ORDER OF PROTECTION-FOREIGN Synopsis of Bill as introduced: Amends the Code of Criminal Procedure of 1963, the Unified Code of Corrections, the Code of Civil Procedure, and the Domestic Violence Act of 1986. Authorizes a court to order compliance with an order of protection issued by the court of another state, tribe, or United States territory as a condition of bail, parole, mandatory supervised release, or supervision. Provides for filing of a foreign order of protection with the circuit clerk, and requires the clerk to file the order with the sheriff or other law enforcement officials charged with maintaining Department of State Police records. Provides that a foreign order of protection is entitled to full faith and credit in this State. HOUSE AMENDMENT NO. 1. Deletes provisions amending the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986 and providing that a court, law enforcement officer, or other person who enforces an order of protection based upon a reasonable belief that the order is valid is immune from civil liability for any action taken based on that belief. HOUSE AMENDMENT NO. 2. In provisions amending the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986, in the captions of Sections added by the bill concerning the filing of an order of protection issued in another state, deletes references to "immunity".
